AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE
BIDDING FOR LEASING OXYGEN INJECTION EQUIPMENT AND PURCHASE OF
LIQUID OXYGEN FOR THE FAYETTEVILLE POLLUTION CONTROL PLANT .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That the Board of Directors hereby waives the
requirements of competitive bidding for leasing of oxygen
injection equipment and purchase of liquid oxygen for the
Fayetteville Pollution Control Plant for the reason
that said requirements are not feasible because the initiation
of said treatment is needed immediately to safeguard the public
health , safety , and welfare , and because the Linde Division
of Union Carbide Corporation has necessary expertise which
is unavailable from other manufacturers and suppliers .
Section 2 . The Board of Directors hereby determines that
the effluent generated by the Fayetteville Pollution Control
Plant is in need of immediate additional treatment to protect
the public health , safety and welfare , and that the passage
of this ordinance is necessary to provide said treatment .
Therefore , an emergency is hereby declared to exist and this
ordinance being necessary for the public health , safety and
welfare shall be in full force and effect from and after its
passage and approval .
