PRELIMINARY PLAT TO THE PLANNING COMMISSION FOR APPROV �jP C( �Kek
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Article II , Section B of Appendix C to
the Fayetteville Code of Ordinances is hereby amended by adding
the following :
NOTICE REQUIREMENT
Prior to placement of a preliminary plat on the agenda
of the Planning Commission for approval , the subdivider
shall be required to give written notice by registered
or certified mail , return receipt requested , to the
owners of all land which adjoins the proposed subdivision
or which would adjoin the proposed subdivision but for
the existence of a public street . A copy of each notice ,
together with the return receipt , shall be filed with
the Planning Administrator before the proposed plat is
placed on the Planning Commission agenda . Where adjoining
property is jointly owned , notice to one of the joint
owners shall be deemed sufficient . The notice shall be
in substantially the following form :
You are hereby notified that the undersigned subdivider
has submitted to the Fayetteville Planning Commission for
approval a preliminary subdivision plat for property which
adjoins your land . The proposed subdivision would occupy
acres , would have lots , and would be called
The Planning Commission
will consider preliminary plat approval at its meeting on
the day of , 19 , at p . m , in
the Board of Directors Room o -the FayettevilreCity
Administration Building .
SUBDIVIDER
In lieu of the written notice required by this section , the
subdivider may give personal notice of the proposed subdivision
: : ?- by tbbtairiing the signatures of landowners on the proposed plat
and filing said plat with the Planning Administrator .
Section -2 . , The' Board of Directors hereby determines that
the City. '.s existing subdivision regulations do not adequately
regulate the subdivision of land ; that adequate subdivision regula-
tions are essential to the public welfare ; and that the passage
of this ordinance is necessary for the City to have adequate
subdivision regulations . Therefore , an emergency is hereby
declared to exist , and this ordinance being necessary for the
public welfare shall be in full force and effect from and after
its passage and approval .
