J3 g AN ORDINANCE AMENDING ARTICLE 7 , SECTION 21 ( b ) OF APPENDIX A TO THE FAYETTEVILLE CODE OF ORDINANCES TO PROVIDE THAT THE MINIMUM FRONTAGE REQUIREMENT FOR TANDEM LOTS MAY BE A PERPETUAL , PRIVATE EASEMENT , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Article 7 , Section 21 ( b ) of Appendix A to the Fayetteville Code of Ordinances is hereby amended to read as follows : Each residential tandem lot shall have a minimum of 25 feet of lot frontage abutting an improved public street , which frontage shall extend in an equal and uniform width to the principal portion of the lot and shall be utilizable for private drive and utility easement purposes . A perpetual , private easement for the benefit of the owner of the tandem lot , his heirs , and assigns shall meet the frontage requirement pre - scribed hereby . The tandem lot owner shall be responsible for maintaining said 25 foot private drive . Section 2 . The Board of Directors hereby determines that the City ' s existing zoning ordinance does not adequately regulate tandem lot development ; that adequate regulation of tandem lot development is necessary for the public welfare ; and that the passage of this ordinance is necessary to adequately regulate tandem lot development . Therefore , an emergency is hereby declared to exist , and this ordinance being necessary for the public welfare , shall be in full force and effect from and after its passage and approval .
