BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CIRCOEktf?hR/'.
FAYETTEVILLE , ARKANSAS .
Section 1 . That Article 17 of Appendix A to the Fayetteville
Code of Ordinances is hereby amended by changing the definition of
the term "home occupation” to read as follows :
Home Occupation . An occupation , profession , or avocation
conducted in a dwelling unit on a part- time or full - time
basis for which financial compensation is received and
which generates motor vehicle traffic to the dwelling unit
by patrons or clients of the occupation , profession or
avocation conducted therein . A non- traffic generating
occupation , profession or avocation conducted in a
dwelling unit by one or more members of the family
occupying the premises shall be considered a residential
use , and not a commercial use .
Section 2 . The Board of Directors hereby determines that the
City ' s existing zoning regulations do not adequately define and
regulate home occupations ; that adequate definition and regulation
of home occupations is necessary to safeguard the public health ,
safety and welfare ; and that the passage of this ordinance is
necessary to adequately define and regulate home occupations .
Therefore , an emergency is hereby declared to exist , and this
ordinance being necessary for the public health , safely and
welfare shall be in full force and effect immediately after
its passage and approval .
