AN ORDINANCE VACATING AND ABANDONING A UTILITY
EASEMENT ALONG THE NORTH SIDE OF CERTAIN PROPERTY
LOCATED ADJACENT TO U . S . HIGHWAY 71 NORTH .
WHEREAS , the Board of Directors has determined
that the following described utility easement is not
required for corporate purposes .
NOW THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 , That the City of Fayetteville , Arkansas
hereby releases , vacates , and abandons all of its rights
together with the rights of the public generally in and
to the following described easement :
Ten feet of equal and uniform width along the
North side of the following property : A part of
the SE 1 / 4 of the SW 1 / 4 of Section 35 in Township
17 North of Range 30 W (S35 , T- 17 - N , R- 30 ). , and
being more particular )y described as follows , to -wit :
. Beginning at a point which is 40 feet South of
and 145 . 43 feet West of the Northeast corner of
said 40 acre tract , and running thence South 07 °
0.1 ' E 108 . 91 feet , thence South 58 . 55 feet , thence
North 66 ° 38 ' W , 196 . 92 feet to the East right - of -
way U . S . Highway 71 , thence North 24 ° 40 ' 36 " E
along said right - of -way 97 . 40 feet , thence East
126 . 50 feet to the point of beginning .
Section 2 . A copy of this ordinance duly certified
by the City Clerk shoul be filed in the Office of Recorder
of the County and recorded in the Deed records of the County .
