AND MOUNTAIN STREET IN THE CITY OF FAYETTEVILLE ,

WHEREAS , the Board of Directors has the authorA�liyI%URder
Ark . Stat . 19 - 2304 to vacate portions of alleys which are
not required for corporate purposes ; and
WHEREAS , the Board of Directors has determined that the
following described alleys are not required for corporate
purposes .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the City of Fayetteville , Arkansas , hereby
releases , vacates , and abandons all of its rights , together
with the rights of the public generally , subject to utility
easements in the alleys described as follows , to -wit :
Block 18 - Between Locust and Church 1 / 2 block and North
to Meadow 1 / 2 block : Beginning at a point which is 171
feet South of the Northwest corner of Block Eighteen ( 18 )
of the original plat of the Town (now City ) of Fayetteville ,
Arkansas as a point of beginning , thence East 155 feet ,
thence North 171 feet , thence East 10 feet , thence South
181 feet , thence West 165 feet , thence North 10 feet to the
point of beginning .
Block 16 - Between Center and Meadow Street extending from
Block Street 1 / 2 block East : Beginning at the Northwest
corner of Block Sixteen ( 16 ) of the original plat of the
Town (now City ) of Fayetteville , Arkansas and running 156
feet South to the point of beginning , thence East 110 feet ,
thence South 10 feet , thence West 110 feet , thence North
10 feet , to the point of beginning .
Section 2 . The City of Fayetteville hereby reserves ease -
ments on , over , across , and under the above described alleys to
construct , lay , remove , relay , enlarge , and operate water and/ or
sewer pipeline ; said easement shall be for the benefit of the City
of Fayetteville and for the electric power companies , telephone
companies , gas companies and cable television companies .
Section 3 . As a condition to the above abandonment of said
alleys , the City shall be held free and harmless from liability
as to any claims of the contiguious property owners for damages
to the property described herein , which damage may result from
the City , or other utility companies removing and relocating
public utility lines located in or across said vacated alleys .

Section 4 . A copy of this ordinance , duly certified by
the City Clerk , shall be filed in the Office of the Recorder
of the County and recorded in the deed records of the County .
