AN ORDINANCE AMENDING ARTICLE 5 , SECTION X , OF APPENDIX A
TO THE FAYETTEVILLE CODE OF ORDINANCES TO PROVIDE THAT MULTI -
FAMILY DWELLINGS ARE A CONDITIONAL USE IN THE R- 0 ZONING
DISTRICT ; TO AMEND THE MINIMUM SETBACK REQUIREMENTS FOR R- 0
PROPERTY WHEN CONTIGUOUS TO AN R- 1 , R- 22 OR R- 3 DISTRICT : AND
TO AMEND THE HEIGHT REGULATIONS FOR BUILDINGS IN AN R- 0 DISTRICT
ADJACENT TO AN R- 1 , R- 29 OR R- 3 DISTRICT .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Article 5 , Section (X) (A ) of Appendix A
to the Fayetteville Code of Ordinances is hereby amended to
read as follows :
(A) Purposes
The residential - office district is designed primarily
to provide area for offices without limitations to
the nature or size of the office , together with com-
munity facilities , restaurants and compatible re -
sidential uses .
Section 2 . That Article 5 , Section (X) (B ) of Appendix A
to the Fayetteville Code of Ordinances is hereby amended by
deleting the following :
Unit 4 - Cultural and recreational facilities .
Unit 9 - Multi - family dwelling -medium density .
Unit 10 - Multi - family dwelling -high density .
Section 3 . That Article 5 , Section (X ) ( C ) of the Fayetteville
Code of Ordinances is hereby amended by adding the following :
Unit 4 - Cultural and recreational facilities .
Unit 9 - Multi - family dwelling -medium density .
Unit 10 - Multi - family dwelling - high density .
Section 4 . That the subsection of Article 5 , Section (X)
(D ) of the Fayetteville Code of Ordinances which reads "From
side property line when contiguous to a residential district
. . . 15 feet " is hereby amended to read as follows :
From side property line when contiguous to
a R- 1 , R- 2 , or R- 3 district . . . 15
feet .
Section 5 . That Article 5 , Section (X ) (F ) of the
Fayetteville Code of Ordinances is hereby amended
to read as follows :
(F ) Height Regulations
There shall be no maximum height limits in R -O
districts , provided , however , that any building
which exceeds the height of twenty feet shall be
set back from any boundary line of any R- 1 , R- 2 ,
or R- 3 District an additional distance of one foot
for each foot of height in excess of twenty feet .
