AN ORDINANCE AMENDING SECTION 6 - 94 OF THE FAYETTEV/ LMESY
CODE OF ORDINANCES TO ADOPT AMENDMENTS TO THE FAYETTEVIft CEE-Rlf
CODE OF FLOODPLAIN BUILDING AND DEVELOPMENT REGULATIONS .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . The amendments to the Fayetteville Code of
Floodplain Building and Development Regulations set out in
Exhibit "A" , attached hereto and made a part hereof , are hereby
adopted by reference thereto as if set out fully herein . Three
copies of said admendments shall be maintained in the Office
of the City Clerk .
Section 2 . The Board of Directors hereby determines that
the proper regulation of development within floodplain areas
is essential to the public welfare and that the immediate
passage of this ordinance is necessary for such regulation .
Therefore , an emergency is hereby declared to exist , and this
ordinance being necessary for the public health , safety , and
welfare shall be in full force and effect after its passage .

EXHIBIT "All Ordinance 2412 _
Amendments to the Fayetteville Code of
Floodplain Building and Development Regulations
1 . Section 2904 ( 2) is amended to read as follows :
Within any designated special flood hazard
area ( zone "A") designated by the Federal
Insurance Administration on its Flood Hazard
Boundary Map (FHBM) Number 050216 , for
Fayetteville , Arkansas , dated December 28 ,
1973 and any revisions thereto . Said Flood
Hazard Boundary Map shall be the controlling
map for purposes of complying with the re-
quirements of the national flood insurance
program .
2 . Section 2921 ( 2) is amended to read as follows :
(2 ) FHB Map - the areas of special flood hazard
identified by the Federal Insurance Administration
on the Flood Hazard Boundary Map (FHBM) , Number 050216 ,
for Fayetteville , Arkansas , dated December 28 , 1973
and any revisions thereto .
3 . Section 2933 (8) is amended to read as follows :
(8) Limitations on Granting Variances .
Variances shall not be approved or granted by _
the Building Board Adjustment and Appeals
(Appeal Board) for any proposed development
which will be located whithin any special flood
hazard area ( zone "A" ) of the City if :
(i) The proposed development and the variance
would cause an increase of more than one foot
in the base flood elevation at that site .
( ii) The proposed development and the variance
would result in the elevation of the lowest floor
of a new structure being below the base flood ele-
vation at the site , or would result in the lowest
floor of an addition to an existing structure being
more than two feet below the base flood elevation
at the site .
4 . Section 2933 (9) (c ) is amended to read as follows :
(c ) Any applicant to whom a variance is granted
shall be given a written notice from the City
Building Inspection Superintendent ( local admini -
strator) . This notice shall inform the applicant
of the lowest elevation at which the lowest floor
of the proposed structure can be built according
to the variance approved by the City Board of
Adjustment and Appeals (Appeal Board) and shall
inform the applicant that the cost of flood
insurance will be commensurate with the increased
risk resulting from the reduced elevation of the
lowest floor .
S . Section 2941 (3) is amended to read as follows :

Pending receipt by the City of Fayetteville from
the Federal Insurance Administrator of a Flood
Insurance Rate Map (FIRM) and date with which
to identify special floodway areas within the
City , the placement of mobile homes in--.any
special - flood hazard araa ( ione ;'A!') shall - be
regulated as follows , provided , existing mobile
home subdivisions and parks shall be exempt
from these regulations and persons locating
mobile homes in existing mobile home subdivisions
or parks shall not be required to comply with
these regulations :

(a) Development Permit .
Prior to the placement or relocation of
any mobile home within any special flood
hazard area ( zone "A") , a development
permit shall be obtained from the City
Building Inspection Superintendent ( local
administrator) .
(b) Anchoring of Mobile Homes .
All mobile homes hereafter placed in any
special flood hazard area ( zone "A") shall
be anchored as herinafter required .
This requirement shall apply to all mobile
home sites even though the elevation of the
specific mobile home pad or site in question
may be above the base flood elevation .
Specific requirements for anchoring mobile
homes shall be as follows :
( i ) Over the top ties at each of the four
corners of the mobile home , with two additional
ties per side at intermediate locations ; one
additional tie per side shall be required for
mobile -homes with a length of less than fifty
feet ;
(ii ) Frame ties at each corner of the home
with five additional ties per side at intermediate
points ; four additional ties per side shall be
required for mobile homes with a lenght of less
than fifty feet ;
( iii) All components of the anchoring system
shall be capable of carrying a force of
4 , 800 pounds ;
(iv) Any additions to the mobile home be
similarly anchored .
( c) Construction Standards for Mobile Home Sites .
The following minimum design standards shall apply
to ( 1 ) 'the construction of new mobile home sub-
divisions or parks , (2 ) the expansion of existing
mobile home subdivisions or parks by the construction
of additional lots or spaces , ( 3) the repair , re -
construction or improvement of the streets , utilities
and pads equals or exceeds fifty percent of value of
the streets , utilities and pads before the repair ,
reconstruction or improvement has commenced , or (4 )
the placement of a mobile home at an approved location
other than a mobile home subdivision or park when
the proposed site is located in a special flood
hazard area ( zone "A" ) :
( i) Stands , pads or lots shall be elevated on
compacted fill or on pilings so that the lowest
floor of the mobile home is elevated with a
minimum " freeboard" of two feet above the base
flood elevation . A registered professional
engineer , architect or land surveyor shall sub -
mit a certificate to the Building Inspection
Superintendent ( local administrator) that the
requirements of this subsection are satisfied .

( ii) Adequate surface drainage and access for a
hauler shall be provided ;
( iii ) Where elevation is on pilings , lots shall
be large enough to permit steps , piling foundation
shall be placed in stable soil no more than ten feet
apart , and enforcement shall be provided for pilings
more than six feet above the ground level .
(d) Responsibility for Providing Information .
The responsibility for providing information to the
City Building Inspection Superintendent ( local
administrator) necessary to obtain the development
permit required hereby and necessary for the local
administrator to determine whether the anchoring
requirements prescribed hereby have been complied with ,
shall be as follows :
( i) New mobile home subdivisions and parks where lots
or spaces are not individually owned : the owner or the
agent of the owner of the mobile home subdivision or
park .
(ii ) New mobile home subdivisions and parks where
lots are sold to individuals : the owner of. the mobile
home .
(iii) All other property within the city : the owner
of the mobile home .
