AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE
BIDDING FOR " THERMAL PLAYING 11 OF PORTIONS OF DICKSON STREET ,
MAPLE STREET , AND LAFAYETTE STREET .
WHEREAS , portions of Dickson Street , Maple Street and
Lafayette Street are presently in a state of disrepair ; and
WHEREAS , said state of disrepair creates traffic hazards ;
and
WHEREAS , the traffic on said streets will be increasing
tremendously in the immediate future with the return of students
for the fall semester of the University of Arkansas ; and
WHEREAS , the Board of Directors has determined that it is
essential for the public health , safety and welfare that the
aforesaid streets be repaired as soon as possible ; and
WHEREAS , the Board of Directors has determined that com-
petitive bidding for said improvements is not feasible in
view of the immediate need of said repairs .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the requirements of competitive bidding
be , and the same hereby are , waived for the " thermal planing"
of ( 1 ) Dickson Street from College Avenue to West Avenue ; ( 2 )
Maple Street from Arkansas Avenue to Garland Avenue , and ( 3 )
Lafayette Street from College Avenue to Highland Avenue .
Section 2 . That the Mayor and City Clerk be , and they
hereby are , authorized and directed to execute a contract with
Jim Jackson Company for the aforesaid improvements to Dickson
Street , Maple Street , and Lafayette Street at a total contract
price of $ 10 , 077 . 00 .
Section 3 . The Board of Directors hereby determines that
the aforesaid portions of Dickson Street , Maple Street , and
Lafayette Street are in a state of disrepair ; that said disrepair
creates traffic hazards on said streets ; that the traffic on
said streets will be increasing tremendously very shortly with
the return of students for the fall semester of the University
of Arkansas ; that the immediate repair of said streets
is necessary for the public health , safety , and welfare ; and
that the passage of this ordinance is necessary to accomplish
the immediate repair of said streets . Therefore , an emergency
is hereby declared to exist , and this ordinance being necessary
for the public health , safety and welfare , shall be in full
force and effect from and after its passage .
