AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO ABATE UNSIGHTLY , UN-
SANITARY AND UNSAFE CONDITIONS EXISTING ON CERTAIN PROPERTY LOCATED AT 726 WEST SIXTH
STREET , CITY OF FAYETTEVILLE .
WHEREAS , Mrs . Rose Hallstone is the owner of certain property located at 726 West
Sixth Street , Fayetteville , Arkansas 72701 , and more particularly described as part of
the Ek , Block 14 , County Court Plat , SE', SW',, Section 16 , Township 16 , Range 30 West ,
Fayetteville , Arkansas ; and

WHEREAS the aforesaid property is unsightly , unsafe , unsanitary andfdetrimental
to the public health , safety and welfare ; and 2 -

WHEREAS , the owner of the aofresaid property , after having been given:�we),R.I over -
twenty (20 ) days notice to do so , has neglected and refused to remove , cabAte , or
otherwise eliminate the unsightly , unsafe , unsanitary conditions existinng� n fa -

NOW, THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY .9F n K
FAYETTEVILLE , ARKANSAS :
Section 1 . That under the authority of Ark . Stats . 19 - 2803 , 19 - 2325 , and 192328 ,
Section 11- 1 and 11 - 3 of the Fayetteville Code of Ordinances , and Section 103 . 4 of the
Southern Standard Building Code , 1976 Edition , as adopted by Section 6- 34 of the
Fayetteville Code of Ordinances , the City Manager , or his duly authorized representative ,
is hereby authorized and directed to raze , remove , and do whatever is necessary to
correct the unsightly , unsanitary , and unsafe conditions and buildings existing on the
aforedescribed properties .
Section 2 . That the City Manager is hereby authorized and directed to charge the
cost of correcting said conditions to the owner of said property ; and under the
authority of Ark . Stat . 19- 2326 and Section 11 - 3 of the Fayetteville Code of Ordinances ,
the City of Fayetteville shall have a lien against the aforesaid properties for such
costs .
Section 3 . That the City Attorney is hereby authorized to enforce the aforesaid
liens within eighteen ( 18 ) months after work has been done by action in the Washington
County Chancery Court .
Section 4 . The Board of Directors hereby determines that the conditions existing
on the aforesaid property are unsightly , unsanitary , dilapidated , unsafe , and detrimental
to the public health , and further determines that unless the provisions of this Ordinance
are put into effect immediately , the public health , safety and welfare of the people
of Fayetteville will be adversely affected . Therefore , an emergency is hereby declared
to exist , and this Ordinance being necessary for the public health , safety and welfare
shall be in full force and effect from and after its passage .
