AN ORDINANCE VACATING A PORTION OF SUMMERHILIA(DRIVE�Lhi.

WHEREAS , the Board of Directors has the authority under
Ark . Stat . 19 - 2304 to vacate portions of streets which are not
_y required for corporate purposes ; and
,v WHEREAS , the Board of Directors has determined that the
V following described portion of Summerhill Drive is not required
for corporate purposes .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the following described portion of Summer-
hill Drive be , and the same is hereby , vacated :
A tract of land in Summerhill , a planned unit develop-
ment , which is located in the West Half (W/2 ) of the
Southwest Quarter ( SW/4 ) of Section 25 , Township 17
North , Range 30 West , Fayetteville , Washington County ,
Arkansas , and being more particularly described as
follows : Beginning at a point 187 . 5 feet West and
8 . 7 feet North of the Southeast corner of said
Summerhill ; thence West 27 feet ; thence N 140 45 ' E 53
feet ; thence S 140 45 ' E 53 feet to the point of
beginning .
The above tract also being described as that area
within the concrete curbed island in the center of
Summerhill Drive at Stubblefield Road .
Section 2 . That this ordinance shall be in full force and
effect from and after the date on which the developers of
Summerhill , a planned unit development , file of record in the
office of the Washington County Circuit Clerk and Ex-Officio
Recorder protective covenants providing that the aforesaid property
shall be maintained by the developers or by a property owners
association .
