Home My WebLink AboutOrdinance 2344 FILED FUR KE M 1977 JUN 17 AN 9: 39 ORDINANCE NO . oZ3yY WASHIidGTOil COUNTY, ARK ALMA KOLLMEYER CIRCUIT CLERK (J AN ORDINANCE AMENDING SECTION 17B- 7 ( c ) OF THE FAYETTEVILLE CODE OF ORDINANCES TO PROVIDE THAT DIRECTIONAL SIGNS MAY BE ERECTED ON CITY STREET NAME SIGN POSTS OR TRAFFIC SIGN POSTS FOR CERTAIN PURPOSES AND UNDER CERTAIN CONDITIONS . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Section 17B- 7 ( c ) of the Fayetteville Code of Ordinances is hereby amended to read as follows : ( c ) ( 1 ) Placing signs on public property . No signs other than signs placed by agencies of government shall be erected on any public property ; provided , directional signs may be erected upon city street name sign posts , or upon traffic sign posts under the following conditions : ( a) The signs direct the reader to the lo- cation of a public facility attended principally by out of town patrons , to a facility operated by a non-profit entity and attended principally by out of town patrons , to a facility relating to the public health , safety or welfare , or to scenic or historic trails . ( b ) The signs are fabricated , erected and maintained by the City Traffic Department ; ( c ) The entire cost of the signs is borne by the entity requesting the signs ; ( d ) The signs are installed at locations where they would not constitute a traffic hazard ; ( e) The signs conform to the Manual on Uniform Traffic Control Devices ; and ( f ) The maximum number of directional signs permitted under this section shall be seven ( 7 ) for each entity ; provided the limitation provided hereby shall not apply to signs directing the reader to scenic or historic trails . ( 2 ) Placing signs on private property . No signs shall be placed on any private property without the consent of the owner thereof . ( 3 ) Placing signs on trees or rocks . No signs shall be placed on any utility pole except for utility identification or similar purposes . Section 2 . That all ordinances or parts thereof in conflict herewith are hereby repealed . Section 3 . The Board of Directors hereby determines that the present regulations applicable to the placing of signs on public and private property do not effectively regulate such use of signs ; that the effective regulation of such use of signs is necessary for the public health , safety and welfare ; and that the passage of this ordinance is necessary to effectively regulate the use of such signs . Therefore , an emergency is hereby declared to exist , and this ordinance being necessary for the public health , safety and welfare , shall be in full force and effect from and after its passage .
