AN ORDINANCE WAIVING THE REQUIREMENT OF COMPETITIVE
BIDDING FOR THE PURCHASE OF A SEWER TAP MACHINE FOR THE WATER
AND SEWER DEPARTMENT OF THE CITY OF FAYETTEVILLE .
WHEREAS ,the City of Fayetteville is in immediate need of a
sewer tap machine for the Water and Sewer Department ; and
WHEREAS , because of said immediate need , it would not be
feasible to advertise for competitive bids for the purchase of
said sewer tap machine .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the requirement of competitive bidding
for the purchase of a sewer tap machine , including drill , hose
assembly , four inch diamond bits , six inch diamond bits , and
bit adapters be , and the same hereby is , waived because com-
petitive bidding procedure is not feasible in view of the City ' s
immediate need for said equipment .
Section 2 . The Board of Directors hereby determines that
in order for the City to provide adequate sanitary sewer service
to its citizens , numerous sewer taps must be made immediately ;
that the City does not have the necessary equipment to make said
sewer taps ; and that the passage of this ordinance is necessary
for the City to immediately acquire said equipment . Therefore ,
an emergency is hereby declared to exist , and this ordinance
being necessary for the preservation of the public health , safety
and welfare , shall be in full force and effect from and after
its passage .
