AN ORDINANCE AUTHORIZING AND DIRECTING THE ,
TO ABATE UNSIGHTLY , UNSANITARY AND UNSAFE CONDWWWOL0 ING
ON CERTAIN PROPERTY LOCATED IN THE CITY OF FAYEW}stIT4%Vp,K
WHEREAS , Ira L . Hammond is the owner of certain property
located at the intersection of Appleby Road and North College
Avenue in the City of Fayetteville , and more particularly de-
scribed as part of the SW/ 4 of the NE/4 of Section 35 , Township
17 North , Range 30 West ; and
WHEREAS , Robert Westphal is the owner of certain property
located at 4291 West Sixth Street in the City of Fayetteville ,
and more particularly described as Part of the E /2 of the SW/ 4
of Section 21 , Township 16 North , Range 31 West ; and
WHEREAS , Don Thornesberry is the owner of certain property
located at 380 West 24th Street in the City of Fayetteville
and more particularly described as Part of the NW/4 of the NE/4
of Section 28 , Township 16 North , Range 30 West ; and
WHEREAS , the aforesaid properties are unsightly , unsafe ,
unsanitary and detrimental to the public health , safety , and
welfare ; and
WHEREAS , the owners of the aforesaid properties , after
having been given well over 20 days notice to do so , have
neglected and refused to remove , abate , or otherwise eliminate
the unsightly , unsafe , unsanitary conditions existing on the
aforesaid properties .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That under the authority of Ark . Stats . 19 - 2803 ,
19 - 2325 - 19- 2328 , Section 11- 1- 11- 3 of the Fayetteville Code of
Ordinances , and Section 103 . 4 of the Southern Standard Building
Code , 1976 Edition , as adopted by Section 6- 34 of the Fayetteville
Code of Ordinances , the City Manager , or his duly authorized
representative , is hereby authorized and directed to raze , remove ,
and do whatever is necessary to correct the unsightly , unsanitary ,
and unsafe conditions and buildings existing on the aforedescribed
properties .
Section 2 . That the City Manager is hereby authorized and
directed to charge the cost of correcting said conditions to the
owners of said properties ; and under the authority of Ark . Stat .
19 - 2326 and Section 11- 3 of the Fayetteville Code of Ordinances ,
the City of Fayetteville shall have a lien against the aforesaid pro-
perties for such costs .
Section 3 . That the City Attorney is hereby authorized
to enforce the aforesaid lienswithin 18 months after work has
been done by action in the Washington County Chancery Court .
Section 4 . The Board of Directors hereby determines that
the conditions existing on the aforesaid properties are unsightly ,
unsanitary , dilapidated , unsafe , and detrimental to the public
health , and further determines that unless the provisions of
this ordinance are put into effect immediately , the public health ,
safety and welfare of the people of Fayetteville will be adversely
affected . Therefore , an emergency is hereby declared to exist , and
this ordinance being necessary for the public health , safety and
welfare shall be in full force and effect from and after its
passage .
