WHEREAS , the Fayetteville Board of Directors has�dete32�ined
that numerous subdivisions have been developed withO& he City 's
designated extra-territorial planning area ; and ? 'c 3= r'"

WHEREAS , the Board of Directors anticipates that de`veloper's'
will seek plat approval for additional suburban subdivisiors9 in _
the future ; and
WHEREAS , the City ' s present subdivision regulations do not
require developers of suburban subdivisions to install all of
the amenities which developers of urban subdivisions are required
to install ; and
WHEREAS , the Board of Directors desires to undertake a study
of subdivision development within the City ' s designated extra-
territorial planning area in order to determine whether developers
of suburban subdivisions should be required to install certain
amenities in addition to those presently required ; and
WHEREAS , the Board of Directors has determined that in order
to give the City the opportunity to make said study without en-
couraging the filing of an influx of applications for approval
of suburban subdivision plats , a moratorium on the approval of
such plats should be ordered .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . A 60 day moratorium on the approval of preliminary
subdivision plats for property located within the City ' s designated
planning area is hereby ordered ; during said moratorium period ,
the Planning Commission shall not approve any preliminary plat
for a suburban subdivision .
Section 2 . The Board of Directors hereby determines that
a study of subdivision development within the City ' s designated
extra -territorial planning area is necessary in order to determine
whether developers of suburban subdivisions should be required
to install amenities in addition to those presently required ;
hereby determines that a moratorium on approval of suburban
subdivision plats is necessary to give the City the opportunity to
make said study without encouraging the filing of an influx
of applications for approval of suburban subdivision plats ;
and that the passage of this ordinance is necessary to order
said moratorium . Therefore , an emergency is hereby declared
to exist , and this ordinance being necessary for the public
health , safety , and welfare , shall be in full force and effect
from and after its passage , ` n
