BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That the second paragraph in Sec . 10 - 28 of the
Fayetteville Code of Ordinances is hereby amended to read as

The monthly residential rate for each single family
dwelling shall be $ 3 . 30 per month for two cans , plus
fifty cents ($ . 50 ) per month for each additional can . Said
cans shall not exceed thirty-two 02 ) gallons each .
Section 2 . That Section 10 - 29 of the Fayetteville Code
of Ordinances is hereby amended to read as follows :
The minimum monthly commercial rate shall be $ 3 . 30
per month for one can for each commercial establishment .
Said cans shall not exceed thirty-two ( 32 ) gallons each .
In the event that commercial establishments require
bulk pick-up service of cartons , crates , baskets or of
any rubbish not placed in thirty-two ( 32 ) gallon capacity
cans , for such commercial establishments the rate for bulk
pick-up service shall be twenty-eight cents ( $ 0 . 28 ) per
minute required per pick-up .
Commercial sanitation service shall be the collection ,
hauling and disposal of garbage , rubbish and other
services provided by the sanitation system of the city ,
twice per week , Monday through Friday , excepting au-
thorized holidays for city employees , in all business
areas .
In the event commercial establishments require more
than one can for any pick-up during a month , the monthly
rate for each additional can shall be twenty-eight cents
( $ 0 . 28 ) times the normal number of monthly pick-ups for
the establishments . No can shall exceed thirty- two ( 32 )
gallons in capacity . In the event commercial establishments
require sanitation service more frequently than twice
each week , the monthly rate for such additional service
shall be twenty-eight cents ( $ 0 . 28 ) per additional pick-up
per can .
Section 3 . That Section 10 - 29 . 1 of the Fayetteville Code of
Ordinances is hereby amended to read as follows :
The rate for any person using Lodal containers for
the collection of garbage shall be $ 1 . 10 per cubic yard
for pick-up .
Section 4 . The Board of Directors hereby determines that
the present sanitation rates do not produce revenues sufficient
for the city to continue to provide adequate sanitation service
to its citizens ; that the provision of adequate sanitation service
by the city is essential for the public health , safety and welfare ;
and that the passage of this ordinance is necessary for the city
to provide adequate sanitation service to its citizens . Therefore ,
an emergency is hereby declared to exist , and this ordinance being
necessary for the public health , safety , and welfare shall be in
full force and effect from and after its passage .
