AN ORDINANCE WAIVING FORMAL BID REQUIREMENTS FOR THE
PURCHASE OF CAST IRON PIPE AND FITTINGS , SOIL PIPE , WATER METERS ,
BRASS WATER AND SEWER ITEMS , COPPER PIPE AND FITTINGS , AND PLASTIC
PIPE AND FITTINGS UNTIL DECEMBER 31 , 1977 .
WHEREAS , the City has previously made unsuccessful efforts
to obtain firm bids for the purchase of cast iron pipe and
fittings , soil Pipe , water meters , brass water and sewer items ,
copper pipe and" fittings , and plastic pipe ; and
WHEREAS , advertisement for competitive bids for such mater-
ials 4s not feasible or practical .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAY.ETTEVILLE , 'ARKANSAS :
Section 1 . That the requirements of competitive bidding
for the purchase of cast iron pipe and fittings , soil pipe ,
water meters , brass water and sewer items , copper pipe and fittings ,
and plastic pipe be , and the same hereby are , waived for the
reason that the City has ascertained that the suppliers
thereof are unwilling to submit firm bids , and the City is in
need of such materials .
Section 2 . That the City Manager be , and he is hereby ,
authorized and directed to make needed purchases of the
above described materials by written quotations until December ,31. ,
1977 .
Section 3 . That the Board of Directors hereby determines
that immediate improvements to the City ' s water and sewer
system are necessary which require the purchase of cast iron
pipe and fittings , soil pipe , water meters , brass water and sewer
items , copper pipe and fittings , and plastic pipe , which improve-
ments are necessary to protect the safety of the citizens of the
City , and that the passage of this ordinance is necessary to
enable such purchase . Therefore , an emergency is hereby de-
clared to exist , and this ordinance being necessary for the
protection of the public health , safety , and welfare shall
be in full force and effect from and after its ((passage .
