AN ORDINANCE VACATING TWO ALLEYS LOCATED IN BL0)
ELEVEN IN PARKSDALE ADDITION TO THE CITY OF FAYETTEV HH Alf 9: 14
WHEREAS , a petition was duly filed with the BoaArdA �r"gors
of the City of Fayetteville , Arkansas on October 29A &A�O ,' "king
the Board of Directors to vacate and abandon all tha,61V RT Y f
two alleys designated on the plat of Parksdale Addition to * 0 City
of Fayetteville , Arkansas , which alleys are hereinafter described ;
and
WHEREAS , after due notice as required by law , the Board of
Directors has , at the time and place mentioned in the notice ,
heard all persons desiring to be heard on the question and have
ascertained that the alleys or portions thereof , hereinafter
described , have heretofore been dedicated to the public use as
alleys herein described ; have not been actually used by the public
generally for a period of at least five years subsequently to
the filing of the plat and are not needed for public purposes ;
that all the owners of the property abutting upon the portion of
the alleys to be vacated have filed with the Board of Directors
their written consent to such abandonment ; and that the public
interest and welfare will not be adversely affected by the aban-
donment of such alleys .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the Board of Directors hereby releases ,
vacates and abandons all. its rights , together with the rights
of the public generally , in and to the alleys designated as
follows :
A twenty ( 20 ) foot alley abutting the South property
lines of Lots Fifteen ( 15 ) , Sixteen ( 16 ) , Seventeen
( 17 ) , Eighteen ( 18 ) and Nineteen ( 19 ) of Block Eleven
( 11 ) of Parksdale Addition to the City of Fayetteville ,
Arkansas , as per plat of said addition on file in the
office of the Circuit Clerk and Ex-Officio Recorder of
Washington County , Arkansas ;
ALSO ,
A. twenty ( 20 ) foot alley abutting the West property
line of Lot Nineteen ( 19 ) in Block Eleven ( 11 ) of
Parksdale Addition to the City of Fayetteville , Ar-
kansas , as per plat of said addition on file in the
office of the Circuit Clerk and Ex-Officio Recorder
of Washington County , Arkansas ,
Section 2 . The City of Fayetteville hereby reserves a
utility line and drainage easement on , over , across , and under
the above described alleys to construct , lay , remove , relay ,
enlarge and operate public utility lines and drainage structures .
SectionA . As a condition to the abandonment of said alleys ,
the city shall be held free and harmless from liability as to any
claims of the contiguous property owners for damages to the property
described herein , which damage may result from the city constructing ,
laying , removing , relaying , enlarging or operating public utility
lines and drainage structures in and upon said vacated alleys .
Section 4 . A copy of this ordinance duly certified by the
City Clerk shall be filed in the office of the Recorder of the
County and recorded in the deed records of the County .
