OF ORDINANCES TO AMEND THE HEIGHT REGULATIONS

BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
It shall be unlawful to erect any free- standing
sign whose total height is greater than 30 feet above
the level of the street upon which the sign faces .
Free- standing signs located on property which abuts
both a controlled access highway and a state or federal
numbered highway may not be erected where the total
height of said sign is greater than 30 feet above the
plane of the pavement of the highest road at the inter-
section . For any sign located closer to street right -
of-way than 40 feet the maximum height shall be reduced
one-half ( 1/ 2 ) foot for each foot of set-back less than
40 feet . Free-standing signs shall be permitted to be
erected in the city subject to the following :
Section 2 . That all ordinances or parts hereof in conflict
herewith are hereby repealed .
Section 3 . The Board of Directors hereby determines that
the present regulations applicable to the use of free - standing
signs should be changed to facilitate the effective enforcement
of the city ' s sign ordinance , which enforcement is hereby found
to be necessary for the preservation of the public health , safety
and welfare ; and the Board of Directors hereby determines that the
passage of this ordinance is necessary to make said changes and
thus facilitate the effective enforcement of the city ' s sign
ordinance . Therefore , an emergency is hereby declared to exist
and this ordinance being necessary for the preservation of the
public health , safety and welfare shall be in full force and
effect from and after its passage .
