BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Section 17B- 8 of the Fayetteville Code
of Ordinances is hereby amended to read as follows :
Sec . 17B- 8 . Roof signs .
Roof signs shall not be permitted except on appeal to
the Board of Sign Appeals . The Board of Sign Appeals
may grant a variance for a roof sign only in those cases
where the applicant demonstrates practical difficulties
in utilizing a wall sign and demonstrates that the variance
will be in keeping with the spirit and intent of this
chapter .
Section 2 . The Board of Directors hereby determines that the
present regulations applicable to roof signs should be changed
to facilitate the effective enforcement of the city ' s sign
ordinance , which enforcement is hereby found to be necessary
for the preservation of the public health , safety and welfare ;
and the Board of Directors hereby determines that the passage
of this ordinance is necessary to make said changes . Therefore , .
an emergency is hereby declared to exist and this ordinance
being necessary for the preservation of the public health ,
safety and welfare , shall be in full force and effect from and
after its passage . ''.. J
