AN ORDINANCE AMENDING CHAPTER 15 OF THE FAYEr.ATN IE ' P.E
OF ORDINANCES TO ADOPT THE ARKANSAS STATE GAS CODE ; i 0T,>If
THE REQUIREMENT OF A LOCAL LICENSE FOR PLUMBERS AND GAS FITTERS
AND TO CLARIFY THE REGULATIONS APPLICABLE TO PLUMBING AND GAS
FITTING WITHIN THE CITY OF FAYETTEVILLE .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Article I, of Chapter 15 of the Fayetteville
Code of Ordinances is hereby amended as follows :
( 1 ) Section 15- 2 of the Fayetteville Code of Ordinances
is hereby repealed and Section 15 - 3 is hereby renumbered Section
15- 2 .
( 2 ) Sections 15 - 4 , 15 - 5 , 15- 6 , 15- 7 , 15 - 8 , 15 - 9 ,
15 - 10 , 15 - 10 . 1 , 15- 11 , 15 - 12 , and 15- 17 of the Fayetteville Code
of Ordinances are hereby repealed .
( 3 ) Section 15 - 13 of the Fayetteville Code of
Ordinances is hereby renumbered Section 15 - 3 and is hereby
amended to read as follows :
Sec . 15 - 3 . Plumbing permits .
( 1 ) Permit required . A plumbing permit shall be
applied for and obtained from the City Plumbing Inspector ' s
Office before beginning any plumbing work in the corporate
limits of the City of Fayetteville , Arkansas .
( 2 ) Persons qualified to obtain plumbing permits . The
City Plumbing Inspector is authorized to issue plumbing
permits to the following :
( a ) State licensed master plumbers .
(b ) Property owners : A permit may be issued to a
property owner to install plumbing in a single family
residence , provided the property owner does the work
himself , and the building is owned and occupied by
such owner as his home . Such plumbing work must strictly
comply with the requirements of this article ,
( 4 ) Section 15 - 14 of the Fayetteville Code of
Ordinances is hereby renumbered Section 15 - 4 and Section 15- 15 is
hereby renumbered Section 15 - 5 .
( 5 ) Section 15 - 16 of the Fayetteville Code of
Ordinances is hereby renumbered Section 15 - 6 and is hereby amended
to read as follows :
Sec . 15 - 6 . Refusal of permit .
Any person engaged in the business of installing '
plumbing work who shall fail to correct promptly any
defect in any work done by him contrary to this article
after having been notified to do so by the Plumbing
Inspector , shall not be issued any further permits until
such defect has been corrected .
( 6 ) Section 15 - 18 of the Fayetteville Code of Ordinances
is hereby renumbered Section 15 - 7 , Section 15 -19 is hereby

Section 2 . That Article II of Chapter 15 of the Fayetteville
Code of Ordinances is hereby amended as follows :
( 1 ) Section 15 - 61 is hereby amended to read as follows :
Sec . 15- 61 . State Gas Code adopted .
There is hereby adopted by the Board of Directors of
the City of Fayetteville , Arkansas , by reference thereto ,
the provisions set forth in Chapter 15 entitled " Installation
of Consumers Gas Piping and Gas Appliances " ( as established
by Act 902 of 1975 , General Assembly of the State of Arkansas )
which is known as the " Arkansas State Gas Code " as set forth
in the pamphlet entitled " Arkansas State Plumbing Code , Rules
and Regulations of the State Board of Health Governing the
Construction , Installation , and Inspection of Plumbing and
Drainage , 1971 Fifth Edition " , issued by the Arkansas State
Board of Health , Little Rock , Arkansas , save and except
such portions of said Code as are hereinafter deleted , modi -
fied or amended , and the provisions contained in said
pamphlets are hereby adopted and incorporated as fully as if
set forth at length herein , and the provisions thereof shall
be controlling within the corporate limits of the City of
Fayetteville , Arkansas .
( 2 ) The following sections are hereby repealed : 15 - 62 ,
15 - 63 , 15 - 64 , 15 - 66 , 15 - 67 , 15 - 68 , 15 - 69 , 15 - 70 , 15 - 71 ,
15 - 72 , and 15 - 77 .
( 3 ) Section 15 - 65 of the Fayetteville Code of
Ordinances is hereby renumbered Section 15 - 62 .
( 4 ) Section 15 - 73 of the Fayetteville Code of Or-
dinances is hereby renumbered Section 15 - 63 and is hereby
amended to read as follows :
Sec . 15 - 63 . Gas permits .
( 1 ) A gas permit shall be applied for and obtained
from the City Gas Inspector ' s Office before beginning any
gas piping work in the corporate limits of the City of
Fayetteville , Arkansas .
( 2 ) Persons qualified to obtain gas permit . The City
Gas Inspector is authorized to issue gas permits to the
following :
( a ) State licensed supervising gas fitter or state
licensed master plumber and gas fitter.
(b ) Property owners . A . permit ' may -be , ,issued to a
property owner to install gas piping in a single family
residence , provided the property . .owner ' does the work
himself , and the building is owned and '. oCcupied . by' such
owner as his home . Such gas piping ' work must strictly
comply with the requirements of this article. `
( 5 ) Section 15 - 74 of the Fayetteville Code of Or-
dinances is hereby renumbered Section 15- 64 and is hereby
amended to read as follows :

Sec . 15 - 64 . Gas permit fees .
( 1 ) General . No permit shall be valid until the fees
prescribed in this section shall have been paid .
( 2 ) Gas piping permit fees . For the purpose of estab-
lishing gas permit fees for remodeling work and/or new work ,
" gas outlets " shall mean every threaded connection in the
gas piping system to which a gas burning appliance or device
is or may be attached . The applicant shall pay the following
permit fee :
( a ) 5 gas outlets , or less $ 10 . 00
( b) 6 or more gas outlets 15 . 00
( c ) Testing ahead of gas meter fee . When the gas
meter loop is located on private property or in such
a way that an inspection and pressure test must be
made on the gas piping between the gas meter and the
gas company gas main , an additional gas permit fee
of $ 5 . 00 shall be added to the above gas permit fees .
The licensed gas fitter or property owner shall provide
an opening so that this portion of the gas piping can
be tested against the valve at the gas regulator .
( 3 ) Installation of gas equipment permit fees . For the
purpose of establishing gas equipment permit fees for re -
modeling work and/or new work , gas appliances shall mean every
appliance that is connected to the gas piping system where the
installation of a gas vent , or a return air plenum , or a duct
system of any kind is required in order for that gas appliance
to operate properly . The applicant shall pay the following fee :
( a ) Gas appliance
1 . Heating unit or furnace $ 5 . 00 (plus $ 0 . 25 per
heating outlet in-
stalled in the building
2 . Water heaters $ 5 . 00
3 . Gas vents for flue gases 5 . 00
( b) Gas boilers 10 . 00
(NOTE ) Kitchen gas ranges , domestic clothes dryers , and
unvented space heaters are exempted and gas permits are not
required to connect these appliances to an existing gas outlet
in an existing gas piping system .
If a plumbing permit fee has been paid to the city for the
installation of a water heater by the plumber on the job ,
or if a gas fitters permit fee has been paid to the city for
the installation of a gas heating unit or gas appliance by
the gas fitter on the job , then the person installing the
gas vents for venting the flue gases for these installations
may obtain a gas fitters permit from the city at no additional
fee cost , prior to installing said gas vents .
( 4 ) Large building fees . An additional fee of $ 5 . 00 per
inspection trip shall be charged when the size of the building
requires more than one pressure test of the gas piping system
from the gas meter loop into the building or buildings served .

( 5 ) Additional fee for re - inspection . When any extra
trips by the gas inspector or his assistants are necessi -
tated by failure of the gas fitter , gas appliance installer
or sheet metal installer who is installing the system to
be ready for an inspection , an additional fee of $ 5 . 00 shall
be charged for every trip so made .
( 6 ) Double gas permit fee . Should any person willfully or
through negligence begin or complete any gas piping work ,
appliance installation or gas vent work for which a gas
permit is required by this article , without having notified
the inspector ' s office or applied for the necessary permit
either prior to or during the day that work is commenced ,
or on the next working day of the gas inspector , where such
work is started on a Saturday , Sunday or holiday , he shall ,
when subsequently securing such permit , be required to pay
double the fees hereinabove provided for such permit ; and
shall be subject to all penal provisions of this article .
( 6 ) Section 15 - 75 of the Fayetteville Code of Ordinances
is hereby renumbered Section 15 - 65 .
( 7 ) Section 15 - 76 of the Fayetteville Code of Ordinances
is hereby renumbered Section 15 - 66 and is hereby amended to
read as follows :
Sec . 15 - 66 . Refusal of permit .

shall not be issued any further permits until such defect
has been corrected .
( 8 ) Section 15- 78 of the Fayetteville Code of Ordinances
is hereby renumbered Section 15 - 67 , Section 15 - 81 is hereby
renumbered Section 15- 70 , Section 15 - 82 is hereby renumbered
Section 15- 71 , Section 15 - 83 is hereby renumbered Section
15 = 72 , and Section 15 - 84 is hereby renumbered Section 15 - 73 .
( 9 ) That Section 15 - 79 of the Fayetteville Code of
Ordinances is hereby renumbered Section 15 - 68 and is hereby
amended to read as follows :
Sec . 15- 68 . Responsibilities of supervising gas fitter
or master plumber and gas fitter .
( 1 ) Advance notice for gas inspection . It shall be
the duty of the supervising gas fitter or- master plumber
and gas fitter or his authorized representative to give
advance notice to the gas inspector when the gas piping
work is ready for an inspection .
( 2 ) Make sure work is ready for inspection . It
shall be the duty of the supervising gas fitter or master
plumber and gas fitter to make sure that the gas piping
work will stand the inspection before he requests the gas
inspector to make an inspection of the gas piping work .
( 3 ) Access to work . It shall also be the duty of
the supervising gas fitter or master plumber and gas
fitter to provide ready access to the premises where the
requested inspection is to be made .

( 10 ) That Section 15 - 80 of the Fayetteville Code of
Ordinances is hereby renumbered Section 15 - 69 and is hereby
amended by adding subsection ( 3 ) to read as follows :
( 3 ) Arkansas Certificate of Inspection .
( a ) Natural gas certificate of inspection . Should
any person for one reason or the other not wish the City
Inspection Department to inspect said natural gas installa-
tion , they shall furnish the City Inspection Department with
a Certificate of Inspection from the Arkansas Board of Health-
Division of Plumbing .
(b ) Liquified petroleum certificate of inspection .
Persons installing liquified petroleum ( LP ) gas installa-
tions in the City must furnish the City Inspection Department
with a copy of the " Report of Installation " that the state
licensed installer is required to file with the Liquified
Petroleum Gas Board of the State Department of Commerce .
( 11 ) Section 15 - 85 of the Fayetteville Code of Ordinances
is hereby repealed .
( 12 ) Section 15 - 85 . 1 of the Fayetteville Code of Or-
dinances is hereby renumbered Section 15 - 74 and is hereby amended
to read as follows :
Sec . 15 - 74 . Mobile homes outside boundaries of mobile
home parks .
Gas systems installed in mobile homes located
on any property other than an authorized mobile home
park shall be installed in accordance with all provisions
of Section 15 . 3 . 1 of the Arkansas State Gas Code .
( 13 ) Section 15 - 85 . 2 of the Fayetteville Code of
Ordinances is hereby renumbered Section 15 - 75 and is hereby
amended to read as follows :
Sec . 15- 75 . Paragraph added to Section 15 . 2 . 10 ,
Section 15 . 2 . 10 of the Gas Code is hereby amended by
adding Paragraph ( a ) to read as follows :
( a ) Gas piping may be tested for tightness with a
mercury guage in lieu of the pressure test on three inch
pressure guage if acceptable to the administrative authority .
( 14 ) Section 15 - 85 . 3 of the Fayetteville Code of
ordinances is hereby repealed .
( 15 ) Section 15 - 85 . 4 of the Fayetteville Code of
Ordinances is hereby renumbered Section 15 - 76 and is hereby
amended to read as follows :
Sec . 15- 76 . Paragraph added to Section 15 . 2 . 5 . 3 ,
of Gas Code .
Section 15. 2 . 5 . 3 of the Gas Code is hereby amended
by adding the following :
The plastic natural gas piping must further meet the
following material specifications ; and compatible fittings
when used for outside plastic natural gas piping :

All plastic pipe approved for use with natural gas shall
bear the manufacturer ' s name or trademark , pipe size , plastic
pipe material designation code , standard dimensions , ratio
number , the ASTM specifications to which the pipe conforms ,
D- 2513 , and the production code number to indicate resins
used in manufacturing .
In order that all underground plastic gas piping can
be located in the future , a tracer wire must be installed
in the same trench with the underground plastic gas piping .
Said tracer wire shall be an insulated ( TW or better ) copper
electrical wire no smaller than number twelve ( # 12 ) in size
installed in the same trench and taped to the plastic gas
piping every twenty- five ( 25 ) feet . This tracer wire shall
be run all the way from the gas main and extending twenty-
four ( 24 ) inches or more above the ground at each point
where the gas piping protrudes above the ground at meter
loop locations and risers in the gas piping . This require-
ment shall not apply to single family residences .
( 16 ) Section 15 - 86 is hereby renumbered Section 15 - 77
and is hereby amended to read as follows :
Sec . 15- 77 . Penalties .
Any person who violates any provision of this article shall
be punished by a fine of not less than $ 10 . 00 nor more than
$ 100 . 00 . Each day during which a violation continues shall
be a separate offense .
Section 3 , The Board of Directors hereby determines that the
present regulations applicable to plumbing and gas fitting are in
need of clarification ; that the adoption of this ordinance is
necessary for such clarification ; and that such clarification is
necessary for the public health , safety , and welfare . Therefore ,
an emergency is hereby declared to exist , and this ordinance being
necessary for the public health , safety and welfare , shall be in
full force and effect from and after its passage .
