AN ORDINANCE AMENDING ARTICLE 10 OF APPENDIX ACITOiiTfieRR
FAYETTEVILLE CODE OF ORDINANCES TO ENLARGE THE MEMBERSHIP OF
THE BOARD OF ADJUSTMENT , TO PRESCRIBE A QUORUM , AND TO AMEND
THE NUMBER OF VOTES NECESSARY TO REVERSE PLANNING ADMINISTRATOR
OR TO GRANT A VARIANCE .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That the first paragraph of Article 10 of
Appendix A to the Fayetteville Code of Ordinances is hereby
amended to read as follows :
The Board of Adjustment shall consist of seven
( 7 ) members with its members to be appointed by the
City Board of Directors , each for a term of five ( 5 )
years . Appointments shall be staggered . A majority
of the membership of the Board of Adjustment shall
constitute a quorum . Members of the Board of Adjust-
ment may be removed from office by the City Board of
Directors for cause upon written charges and after
public hearing . Vacancies shall be filled by resolution .
of the City Board of Directors for the unexpired term
of the member affected .
Section 2 . That the final paragraph of Article 10 , subsection
( 4 ) ( C ) of Appendix A to the Fayetteville Code of Ordinances is
hereby amended to read as follows :
The concurrent vote of a majority of the members
present shall be necessary to reverse any order , re-
quirement , decision or determination of the Planning
Administrator , or to decide in favor of the applicant
on any matter upon which it is required to pass under
this ordinance , or to effect any variation in the
application of this ordinance .
Section 3 . That this ordinance shall be in full force and
effect from and after the time provided by law .
