AN ORDINANCE AMENDING DIVISION 3 OF CHAPTER 6 OF THE
FAYETTEVILLE CODE OF ORDINANCES TO ESTABLISH A BUILDING BOARD
OF ADJUSTMENTS AND APPEALS .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Division 3 of Chapter 6 of the Fayetteville
Code of Ordinances is hereby amended by adding Section 6 - 70 . 1 to
read as follows :
Sec . 6- 70 . 1 . Section 111 . 1 amended .
Section 111 . 1 entitled " Appointment " is hereby amended
to read as follows :
There is hereby established a board to be called
the Building Board of Adjustments and Appeals which
shall consist of five ( 5 ) members . The said Board
shall be appointed by the Chief Appointing • Authority .
Section 2 . That Division 3 of Chapter 6 of the Fayetteville
Code of Ordinances is hereby amended by adding• Section 6 - 70 . 2 to
read as follows :
Sec . 6 - 70 . 2 . Section 111 . 2 amended .
Section 111 . 2 entitled " Term of office " is hereby
amended to read as follows :
Members of the Board shall be appointed for five
( 5 ) year terms which terms shall be staggered . For
the purpose of staggering terms , the Chief Appointing
Authority may appoint an initial member for a term
of less than five ( 5 ) years . Vacancies shall be filled
for an unexpired term by the Chief Appointing Authority .
Continued absence of any member from regular meetings of
the Board shall , at the discretion of the Chief Appointing
Authority , render any such member liable to immediate
removal from office .
