AN ORDINANCE WAIVING FORMAL BID REQUIREMENTS FOR THE PURCHASE
OF LIQUID CHLORINE AND FERRIC CHLORIDE AND FOR THE PCRCHASE OF CLAY ,
BRASS , COPPER , CAST IRON AND PLASTIC WATER AND SEWER PIPE AND
FIXTURES .
WHEREAS , the City of Fayetteville has advertised for compe-
titive bids in the manner required by law for the purchase of liquid
chlorine and ferric chloride and for the purchase of clay , brass ,
copper , cast iron and plastic water and sewer pipe and fixtures ;
and
WHEREAS , the city was unable to obtain firm bids for the purchase
of said items over a one year period .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That formal bid requirements for the purchase of
liquid chlorine in 200 pound cylinders and 150 pound cylinders , for
the purchase of ferric chloride , and for the purchase of clay ,
brass , copper , cast iron and plastic water and sewer pipe and
fixtures are hereby waived for the reason that the city has been
unable to obtain firm bids for the purchase of said items over a
one year period as required by the city ' s needs .
Section 2 . That the City Manager be , and he is hereby ,
authorized and directed to purchase the aforesaid items from
written quotations .
Section 3 . That this ordinance shall be effective for a
period of one year .
Section 4 . The Board of Directors hereby determines that the
immediate purchase of liquid chlorine and ferric chloride and clay ,
brass , copper , cast iron and plastic water and sewer pipe and
fixtures is necessary if the city is to provide essential services
to its citizens and that the passage of this ordinance is necessary
to accomplish said immediate purchase . Therefore , an emergency
is hereby declared to exist and this ordinance being necessary
for the publis health , safety and welfare shall be in full force
and effect from and after its passage .
