AN ORDINANCE AMENDING ARTICLE 6 , SE&IONIi7[ B] tIQF ORDINANCE
NUMBER 1747 (APPENDIX "A " TO THE FAYETTEVILLE CODE OF ORDINANCES )
TO PROVIDE THAT THE PLANNING ADMINISTRATOR SHALL DECIDE THOSE
CASES WHERE THERE IS A QUESTION AS TO WHETHER OR NOT A PARTICULAR
USE IS INCLUDED IN A PARTICULAR USE UNIT .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF ✓
FAYETTEVILLE , ARKANSAS :
Section 1 . That Article 6 , Section [ B ] of Ordinance
Number 1747 (Appendix "A " to the Fayetteville Code of Ordinances )
is hereby amended to read as follows :
[ B ] Interpretation of use units .
In each use unit section , permitted uses are set
forth in the sub- section entitled " Included Uses " . In
the event of a conflict between such sub - sections and the
" description " sub- section , the former shall prevail .
In any case where there is a question as to whether
or not a particular use is included in a particular use
unit , the Planning Administrator shall decide . A use
shall not be interpreted as being in any use unit if
it is specifically listed in another unit in this article .
Section 2 . That all ordinances or parts thereof in conflict
herewith are hereby repealed .
