ALMA ( OLLMEYEIR CIRCUIT CURIIt BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Section 3 - 37 ( a ) of the Fayetteville Code of Ordinances is hereby amended as follows : ( a ) The business of storing , transporting , or selling spiritous , vinous , or malt liquors at wholesale within the City is hereby declared to be a privilege , and for the exercise of such privilege , there is hereby levied an annual license tax in the sum of $ 350 . 00 for each and every such business conducted . Section 2 . That Section 3 - 37 (b ) of the Fayetteville Code of Ordinances is hereby amended to read as follows : ( b ) The business of storing , transporting , selling or dispensing , at retail , any vinous , spiritous or malt liquors within the City is hereby declared a privilege , and for the exercise of such privilege , there is hereby levied an annual license tax in the sum of $ 200 . 00 for each retail store operated within the City . Section 3 . That Section 3 - 90 of the Fayetteville Code of Ordinances is hereby amended to read as follows : The annual tax for a license required by this di - vision shall be as follows : ( 1) For each retailer doing business within the City , $ 15 . 00 for a retailer whose total gross annual sales do _ not exceed $ 1 , 000 ; $ 20 . 00 for a retailer whose total gross annual sales exceeds $ 1 , 000 , but do not exceed $ 2 , 000 ; and $ 20 . 00 for a retailer whose total gross annual sales exceeds $ 2 , 000 , plus an additional $ 5 . 00 for each $ 1 , 000 gross annual sales in excess of $ 2 , 000 . ( 2 ) On or before the 1st day of May , each retail dealer shall file with the City Clerk an annual summary report , certified by an independent Certified Public Accounting firm showing gross revenues received by said retailer from the sale of light wines and/or beer during the preceding year . ( 3 ) That the City Clerk , either personally or through his authorized agents , shall have the right to inspect and examine the records of every retail dealer subject to the tax required by this provision . ( 4 ) Whenever it shall appear to the City Clerk that a retail dealer has secured a permit for an amount less than that which should have been paid therefor , he shall require the payment of the difference or cancel the permit . The City Clerk shall notify the Director of Alcohol Beverage Control of the identity of re - tailers failing to comply with the provisions of this section , in order that the Director may notify whole - sale dealers to discontinue sales to such delinquent MICROFILMED8no ✓v 193 DATE OCT 1 6 1978 �� REEL . 2 - retailers in accordance with Ark . Stat . 48 - 516 . When such license fee is paid to the City Clerk , the Clerk shall notify the Director of Alcohol Beverage Control that such retailer has paid said fee . Section 4 . That all ordinances or parts thereof in conflict herewith are hereby repealed . Section 5 . That this ordinance shall be in full force and effect from and after the time provided by law .
