AN ORDINANCE WAIVING FORMAL BID REQUIREMENTS FOR THE REPAIR AND REHABILI-
TATION OF HOUSES AT 244 E . HUNTSVILLE , 145 E . MEADOW , 111 S . WILLOW , 128 E .
MOUNTAIN, ARBUCKLE LANE , 3516 E . HUNTSVILLE , 305 E . MOUNTAIN , 113 S . WILLOW
and 311 BARTON UNDER THE CITY ' S COMMUNITY DEVELOPMENT PROGRAM .
WHEREAS , the City has previously made unsuccessful efforts to obtain
bids for the repair and rehabilitation of houses within the City under the
City ' s Community Development Program; and
WHEREAS , advertisement for competitive bids for said housing repairs
and rehabilitation is not feasible or practical .
NOW, THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the requirements of competitive bidding for the repair
and rehabilitation of houses located at 244 E . Huntsville , 145 E . Meadow ,
111 S . Willow , 128 E . Mountain , Arbuckle Lane , 3516 E . Huntsville , 305 E .
Mountain , 113 S . Willow and 311 Barton under the City ' s Community Development
Program be , and the same hereby are , waived for the reason that the City has
been unable to obtain bids for said project ,
Section 2 . That the Board of Directors hereby determines that the afore -
said housing repair and rehabilitation projects are necessary to improve the
living conditions of low and moderate income citizens of the City, and that
the passage of this ordinance is necessary to enable said repairs and rehabili -
tation . Therefore , an emergency is hereby declared to exist , and this ordinance
being necessary for the public health and welfare , shall be in full force and
effect from and after the passage hereof.
