Home My WebLink AboutOrdinance 2126 ORDINANCE NO . 414 (o AN ORDINANCE AMENDING ARTICLE 4 , ARTICLE 6 , AND ARTICLE 7 OF APPENDIX A TO THE FAYETTEVILLE CODE OF ORDINANCES : TO CLARIFY THE REGULATIONS APPLICABLE TO THE USE OF SIGNS WITHIN THE CITY ; AND FOR OTHER PURPOSES , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Article 4 , Section 1 of Appendix A to the f/ Fayetteville Code of Ordinances is hereby amended by deleting the following phrase from the last paragraph thereof : i z " by attachment on a building or premises of 0C_ additional signs intended to be seen from off the n `s C:: = 06 premises , or " . c 7C i tv `a r :4 0 Section 2 . That Article 4 , Section 5 ( g ) of Appendix A the Fayetteville Code of Ordinances is hereby amended to re p as follows : ( g) All outdoor advertising signs ( billboards ) not 3 conforming with the provisions of this ordinance shall be removed within the period prescribed by Section 17B- 5 (A ) of the Fayetteville Code of Ordinances . Section 3 . That Article 6 , Section XXIV (A) of Appendix A to the Fayetteville Code of Ordinances is hereby amended to read as follows : (A) Description . Unit 24 consists of outdoor advertising signs (billboards ) on which space is leased or rented by the owners thereof to others for the purpose of con- veying an advertising message . Outdoor advertising is set forth as a single use unit in order to provide maximum control over the location of outdoor adver - tising signs . Section 4 , That Article 7 , Section 16 of Appendix A to the Fayetteville Code of Ordinances is hereby repealed . Section 5 . That Article 7 , Section 9 ( b ) of Appendix A to the Fayetteville Code of Ordinances is hereby repealed ; and Section 9 ( c ) and ( d ) of said Article are hereby designated Section (b ) and (c ) respectively . Section 6 . The Board of Directors hereby determines that there are conflicts between the City ' s zoning ordinance and sign ordinance regarding regulations applicable to the use of signs within the City ; that said conflicts have prevented the effective enforcement of the City ' s sign ordinance , which enforcement is hereby found to be necessary for preservation of the public health , safety and welfare ; and the Board of Directors hereby determines that the passage of this ordinance is necessary for the effective enforcement of the City ' s sign ordinance . Therefore , an emergency is hereby declared to exist , and this ordinance being necessary for the preservation of the public health , safety and welfare , shall be in full force and effect from and after its passage .
