AN ORDINANCE AMENDING ARTICLE 61 SECTION XVI [ B] OF
ORDINANCE 1747 (APPENDIX A TO THE FAYETTEVILLE CODE OF OR-
DINANCES ) TO PROVIDE THAT A RETAIL LIQUOR STORE IS A PER-
MITTED USE UNDER USE UNIT XVI ; AMENDING ARTICLE 7 OF ORDINANCE
1747 BY ADDING SECTION 22 TO PRESCRIBE USE CONDITIONS FOR
RETAIL LIQUOR STORES ; AND FOR OTHER PURPOSES ,
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That Article 6 , Section XVI [ B ] of Ordinance
1747 (Appendix A to the Fayetteville code of Ordinances ) is
hereby amended by adding the following :
Retail Liquor Store .
Section 2 , That Article 7 of Ordinance 1747 is hereby
amended by adding Section 22 to read as follows :
Section 22 . Retail Liquor Stores ,
Retail liquor stores may be located in those zoning
districts where such use is permitted , subject to the
following conditions :
( a) No retail liquor store shall be located within
six hundred ( 600 ) feet of any church , hospital ,
or schoolhouse . For the purpose of this section ,
" schoolhouse " shall include classroom and
dormitory buildings of the University of Arkansas .
(b ) No retail liquor store shall be located on any
property two or more sides of which abutt or
are across the street from and perpendicular
to property zoned residential ( R- 1 , R- 2 , R- 3 , or
R- 0 ) . For the purpose of this section , the
term " street " shall not include any federal
highway .
( c ) A view obscuring fence or hedge not less than
five ( 5 ) feet nor more than eight ( 8 ) feet in
height shall be erected and maintained along
the common boundary of any abutting residential
property ( R- 1 , R- 21 R- 3 , or R- 0 ) .
Section 3 . That this ordinance shall be in full force and
effect from and after the time provided by law .
