AN ORDINANCE WAIVING FORMAL BID REQUIREMENTS FOR THE
PURCHASE OF LIQUID CHLORINE .
WHEREAS , the City has previously made unsuccessful efforts
to obtain firm bids for the purchase of 2 , 000 pound cylinders
and 150 pound cylinders of liquid chlorine ; and
WHEREAS , the City is in need of liquid chlorine ; and
WHEREAS , advertisment for competitive bids for such materials
is not feasible or practical .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the requirements of competitive bidding
for the purchase of 2 , 000 pound and 150 pound cylinders of liquid
chlorine be , and the same hereby are , waived for the reason that
the City has ascertained that the suppliers thereof are unwilling
to submit firm bids , and the City is in need of said materials .
Section 2 . That the Board of Directors hereby determines that
the purchase of liquid chlorine is ncessary to protect the safety
of the citizens of the City , and that the passage of this ordinance
is necessary to enable such purchase . Therefore , an emergency
is hereby declared to exist , and this ordinance being necessary
for the public health , ; safety' 'and welfare , shall be in full force
and effect from and after, the passage hereof .
