Home My WebLink AboutOrdinance 2105 ' FlLED WASHINGTON COUNTY ARKANS MAY 14 I97S� AT......._...................w"?: �.. ... hi ORDINANCE No . a / 6� ALMA KOLLM CIRCUIT CLERK AN ORDINANCE AMENDING SUB-SECTION ( 5 ) OF ARTICLE IV , SECTION 1 OF APPENDIX C TO THE FAYETTEVILLE CODE OF ORDINANCES ; , TO PROVIDE THAT NO CERTIFICATE OF OCCUPANCY SHALL BE ISSUED FOR A LARGE SCALE DEVELOPMENT UNTIL ALL PUBLIC IMPROVEMENTS INSTALLED BY THE DEVELOPER ARE INSTALLED IN CONFORMITY WITH CITY SPECIFI - CATIONS , OR UNTIL A PERFORMANCE BOND TO GUARANTEE SUCH INSTALL- MENT IS POSTED , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Sub- section ( 5 ) of Article IV , Section 1 of the Fayetteville Code of Ordinances is hereby amended to read as follows : ( 5 ) Following administrative approval of a proposed large scale development by the Planning Commission , the development plan shall be forwarded to the City Board of Directors for consideration of final approval and acceptance of dedications . The Board of Directors shall not approve a development plan , until a developer has executed the right-of-way and easement grants re- quired by this ordinance , and the Board of Directors may disapprove a development plan for any of the rea- sons enumerated in Sub- section ( 4 ) above . No building permit shall be issued until the Board of Directors has , by majority vote , passed an ordinance approving the large sacle development and accepting the required right-of-way and easement dedications . No certificate of occupancy shall be issued until all public improve- ments , including but not limited to , water lines , sewer lines and streets , which the developer undertakes to install are installed in conformity with City specifications , or until a performance bond in an amount approved by the City Engineer is posted with the City Inspection Superintendent to guarantee such instal- lation , or until a contract guaranteeing installation of such improvements is executed by the developer ; said contract shall provide that all public improvements shall be installed by the developer within a reasonable period fixed by the contract , and that should the developer fail to install said improvements to City specifications within such period , the City may install the improve- ments and charge the cost thereof to the developer plus interest at the rate of 108 per annum , which amount shall constitute a lien on the property contained in the large scale development . . Section 2 . That all ordinances and parts thereof in conflict herewith are hereby repealed . Section 3'. That this ordinance shall be in full force and effect from and after the time required by law .
