M ALMA K0LLMEYER CIRCUIT CLERK AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 20 OF THE FAYETTEVILLE CODE OF ORDINANCES ; TO PRESCRIBE NEW REGULATIONS FOR THE OPERATION OF AIRPORT LIMOUSINE SERVICE WITHIN THE CITY . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Article III of Chapter 20 of the Fayetteville Code of Ordinances is hereby amended to read as follows : Article III . Airport Limousine Service , Sec . 20 - 34 . Definitions . For the purposes of this Article , " limousine service " is hereby defined to be transportation service over the streets of the City in a type of automobile commonly referred to as a " limousine " , and having a manufacturer ' s seating capacity of at least six ( 6 ) persons , including the driver . "Airport limousine service " is the furnishing of limousine service from and to the Fayetteville Muni - cipal Airport , known as Drake Field , Sec , 20 - 35 , License Tax . It is hereby declared to be a privilege for any person to furnish airport limousine service , and no person shall engage in such undertaking without first paying to the City an annual license tax of $ 25 . 00 , plus $ 5 . 00 annually for each passenger vehicle used on the streets of the City , and furnishing such service , for the privilege in engaging in such business . Such tax shall be paid on or before the first day of January of each year . Sec . 20 - 36 , Fares . Any person furnishing airport limousine service shall not charge a fare for such service in excess of $ 3 . 00 per passenger , one way from point to point . Children aged two through twelve shall be charged half fare , when accompanied by an adult . There shall be no charge for children under two years of age , Sec . 20 - 37 . Parking of Airport Limousines at Drake Field . When at Drake Field , all airport limousines shall be parked in those areas designated for " limousine parking only " . Each person engaged in airport limousine service shall be allocated parking spaces by the City Controller , and shall pay to the City as rental for such parking spaces the sum of $ 20 . 00 per parking space per month . Said rental charge shall be payable to the City Controller by the 10th of each month . Sec . 20 - 38 . Liability Insurance . No person shall furnish airport limousine service unless and until such person has filed with the City Controller a copy of a motor vehicle liability insurance policy , issued by an insurance company authorized to do business in the State of Arkansas , providing for a limit of not less than $ 10 , 000 . 00 for all damages arising out of bodily VOL 883 176 MICROFI DATE 6 197 REEL - 2 - damagesto or death of one person , and subject to same limit for each person , and a total limit of not less than $ 20 , 000 . 00 for all damages arising out of bodily injuries or death of two or more persons in any one accident , and providing for a limit of not less than $ 5 , 000 . 00 for all damages arising out of injury to or destruction of property in any one accident . Sec . 20 - 39 . Penalty for Violation of Article . Any person who violates any provision of this article shall , upon conviction , be punishable by a fine of $ 25 . 00 . Each day ' s violation shall be deemed a separate offense and punishable by a fine of $ 15 . 00 per day . In addition , the City shall have the right to revoke the license required by Section 20 - 35 of - this article for any person who violates any provision of this article . Section 2 . That all ordinances or parts thereof in con- flict herewith are hereby repealed . Section 3 . That this ordinance shall be in full force and effect from and after the time provided by law .
