AN ORDINANCE WAIVING FORMAL BID REQUIREMENTS FOR THE PURCHASE
OF ONE TRAFFIC SIGN HEAT LAMP VACUUM APPLICATOR .
WHEREAS , it is necessary for the traffic department of the
City of Fayetteville , to purchase one traffic sign heat lamp
vacuum applicator ; and
WHEREAS , 3M Company is the only manufacturer of such
equipment .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That pursuant to Ark . Stat . 19 - 4425 , the require -
ments of competitive bidding for the purchase of one traffic sign
heat lamp vacuum applicator be , and the same hereby are , waived
for the reason that there is only one manufacturer of such equipment .
Section 2 . That the Board of Directors hereby determines
that the immediate purchase of one traffic sign heat lamp vacuum
applicator is necessary to protect the safety of the citizens of
the City in their travels along City streets , and that the passage
of this ordinance is necessary to enable the immediate purchase
of said equipment . Therefore , an emergency is hereby declared
to exist , and this ordinance being necessary for the protection
of the public health , safety , and welfare , shall be in full force
and effect from and after its passage .
