\ AN ORDINANCE REQUIRING THE OWNERS OF PROPERTY ON WIiTCH
STRUCTURES HAVING POINTS OF WATER USAGE WITHIN 200 F � qT� COUNTY

BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE Cf-fiYaOFCL . r_ I
FAYETTEVILLE , ARKANSAS :
Section 1 . Within fifteen ( 15 ) months from the effective
date of this ordinance , or within twelve ( 12 ) months from the
date on which City sewer service becomes available in those
areas where service is not presently available , all owners of
property on which structures are located having points of
water usage within 200 feet of a City sewer line shall construct
upon their properties sanitary sewers leading from said points
of water usage to the sanitary sewer of the City , for the
purpose of conducting sewage and liquid wastes into the City ' s
sewerage system .
Section 2 . If a property owner shall fail , neglect , or
refuse to connect to a City sewer line within the time pre -
scribed by Section 1 hereof , unless further time be granted
by the City Manager for such connection , it shall be the duty
of the City Water and Sewer Superintendent to order a discon-
tinuance of water service by the City of Fayetteville to the
property where the owner fails , neglects , or refuses to make
the sewer connections .
Section 3 . It is hereby declared to be a misdemeanor for
any person to fail , neglect , or refuse to connect to a City
sewer line within the time prescribed by Section 1 hereof .
Said misdemeanor shall be punishable by a fine in the amount
of $ 25 . 00 for the first offense , and shall be punishable by
a fine of $ 15 . 00 for each day that such violation continues .
Section 4 . Any property owner making the sewer connection
required hereby shall first obtain the approval of the City
Water and Sewer Superintendent for the nature and character
of the materials to be used in the construction of said sewer
connection , the place of tapping the sewer line of the City ,
and the manner of doing the same .
Section 5 . That all ordinances or parts thereof in con -
flict herewith , and specifically Ordinance Number 1742 ,
Sections 1 through 4 , are hereby repealed .
Section 6 . That the codifier of City Ordinances shall
codify the provisions of this ordinance as Section 21 - 5 . 1 of
the Fayetteville Code of Ordinances .
Section 7 . That this ordinance shall be in full force
and effect from and after the time provided by law .
