AN ORDINANCE VACATING TWO ALLEYS IN PARKSDALE ADDITION
TO THE CITY OF FAYETTEVILLE , ARKANSAS .
WHEREAS , a petition was duly filed with the Board of
Directors of the City of Fayetteville , Arkansas , on the
25th day of July , 1974 , asking the Board of Directors to
vacate and abandon all that portion of two alleys designated
on the plat of Parksdale Addition to said city , now appearing
of record in plat book 4 , page 47 , in the Office of the Recorder
of Washington County , one alley beginning at Brooks Avenue
and ending at Price Avenue , and the other alley beginning at
Walker Avenue ending at Price Avenue ; and
WHEREAS , after due notices as required by law , the
Board of Directors has , at the time and place mentioned in
the notice , heard all persons desiring to be heard on the
question and has ascertained that the alleys hereinbefore
described have heretofore been dedicated to the public use
as alleys herein described ; have not been actually used
by .the public generally for a period of at least five years
subsequent to the filing of the plat ; that all the owners
of the property abutting upon the alleys to be vacated
have filed with the Board of Directors their written consent
to such abandonment ; and that public interest and welfare
will not be adversely affected by the abandonment of such
alleys .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the City of Fayetteville , Arkansas , hereby
releases , vacates , and abandons all its rights , together with
the rights of the public generally , in and to the alleys designated
as follows :
A 20 foot alley lying adjacent to and north of
Lot 3 , Block 3 , of Parksdale Addition to the
City of Fayetteville , Arkansas , and lying
adjacent to and south of Lots 1 and 2 , Block
3 , of Parksdale Addition to the City of Fay-
etteville , Arkansas , said alley being more
particularly described as follows : Beginning
at the SE corner of said Lot 1 and running
thence along the South boundary lines of
said Lots 1 and 2 to the SW corner of said
Lot 2 ; thence Southwesterly to the NW corner
of said Lot 3 ; thence E along the N boundary MiC..O'HLMM
line of said Lot 3 to the NE corner of said DATE OCT 1 6 1911
Lot 3 ; thence Northeasterly to the SE corner REEL

beginning ;
ALSO ;
A 20 foot alley lying adjacent to and E of Lots 3 ,
4 , and 5 . Block 3 , of Parksdale Addition to the
City of Fayetteville , and lying adjacent to and
W of Lot 6 , Block 3 , of Parksdale Addition to
the City of Fayetteville , Arkansas , said alley
being more particularly described as follows :
Beginning at the NE corner of said Lot 3 and
running thence Southwesterly along the E
boundary lines of said Lots 3 , 4 , and 5
to the Southeast corner of said lot 5 ; thence
E to the SW corner of said Lot 6 ; thence North-
easterly along the W boundary line of said
Lot 6 to the N corner of said Lot 6 ; thence
Northwesterly to the NE corner of said Lot 3 ,
said point being the point of beginning .
Provided , the City of Fayetteville , Arkansas , reserves
: u itself and its assigns an easement over , under , and a} pye
described property for the purpose of laying , main-
taining , replacing , and removing public utility and drainage
lines .
Section 2 . A copy of this ordinance duly certified by
the City Clerk shall be filed in the Office of the Washington
County Circuit Clerk and Ex-Officio Recorder and recorded in
the Deed Records of Washington County ,
Section 3 . That this ordinance shall be in full force
and effect from and after the time provided by law .
