AN ORDINANCE WAIVING FORMAL BID REQUIREMENTS FOR CASTS fkW-. ?ri ' CnIR; 7 (
PIPES AND FITTINGS FOR THE REMAINDER OF THE 1974 CALENDAR YEAR : ANPFI .IA'Sd5
FOR OTHER PURPOSES . Lf r„ ISG ji Y -
WHEREAS , the Water and Sewer Department of the City of Fayetteville ,
Arkansas , is required to purchase cast iron pipes and fittings during the
year ; and
WHEREAS , formal bids for the purchase of said cast iron pipe and
fittings have been advertised for and received ; and
WHEREAS , none of the bids received for said cast iron pipe and
fittings contained a firm price for one year .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That pursuant to Ark . Stat . Ann . Sec . 19 -4425 , the
requirements of competitive bidding for the purchase of cast iron pipe and
fittings , be , and hereby are , waived for the remainder of the 1974 calendar
year for the reason that no firm bids were received by the City for the
purchase of said cast iron pipe and fittings .
Section 2 . The Board of Directors hereby determines that the
Water and Sewer Department is in immediate need of cast iron pipe and
fittings to complete certain water and sewer projects within the City , and
that the passage of the Ordinance is necessary for the completion of said
projects . Therefore , an emergency is hereby declared to exist , and this
Ordinance being necessary for the protection of the public health , safety
and welfare , shall be in full force and effect from and after its passage .
PASSED AND APPROVED THIS DAY OF 1974 .
