AN ORDINANCE TO ACCEPT AND CONFIRM THE FINAL PLAT OF
SWEETBRIAR ADDITION TO THE CITY OF FAYETTEVILLE , ARKANSAS ;
AND TO ACCEPT AND CONFIRM THE DEDICATION OF PUBLIC STREET AND
UTILITY EASEMENTS THEREIN .
WHEREAS , there has been presented to the Board of Directors
of the CIty of Fayetteville , Arkansas , a plat known as the final
plat of Sweetbriar Addition to the City of Fayetteville , Arkansas ,
in which the owner has dedicated for the public use the street
and utility easements shown upon said plat ; and
WHEREAS , the Planning Commission of the City of Fayetteville ,
Arkansas , has recommended the acceptance of said plat ;
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the City of Fayetteville , Arkansas , hereby
accepts and confirms the final plat of Sweetbriar Addition to the
City of Fayetteville , Arkansas ; hereby accepts and confirms the
dedication of the street and utility easements shown therein and
hereby declares said street and utility easements to be public
street and utility easements and the Board of Directors hereby
assumes the care , control and jurisdiction of same .
Section 2 . Because the block length limitation `:Tiiposed
by Appendix C -. , Article IV , Section F of the Fayetteville Code of
Ordinances would cause under hardship to the developer of Sweet -
briar Addition , the Board of Directors hereby waives said limitation ,
so that substiantial justice may be done and the public interest
secured . The waiver granted hereby shall not be considered a
precedent for future subdivision5 , but is granted solely because
the aforesaid limitation would cause undue hardship as it applies
to the Sweetbriar Addition .
Section 3 . That this ordinance shall be in full force and
effect from and after its passage , approval and publication .
