AN,D,{r8� r, ff bRI}I VANCE N0 , 1726 , SECTIONS 16 - 11 , 16 - 12 , 16 - 14 , 16 - 15 , ll� -XT 16, ; CODE ` OF ORDINANCES , FAYETTEVILLE , ARKANSAS ; TO DEFINETHETERM CJ PRIVATE SECURITY OFFICER AND PRIVATE SECURITY AGENT ; TO DECLARE THE BUSINESS OF BEING A PRIVATE SECURITY OFFICER OR PRIVATE SECUR - ITY AGENT TO BE A PRIVILEGE FOR WHICH A PERMIT MUST BE OBTAINED FROM THE CITY AND A FIDELITY BOND FILED WITH THE CITY ; TO PROVIDE THAT ALL UNIFORMS WORN BY PRIVATE SECURITY OFFICERS AND PRIVATE SECURITY AGENTS AND ALL VEHICLES AND INDENTIFICATION USED BY SAID OFFICERS AND AGENTS MUST BE APPROVED BY THE CHIEF OF POLICE ; TO PROVIDE A PENALITY FOR ANYONE ACTING AS A PRIVATE SECURITY OFFICER OR PRIVATE SECURITY AGENT WITHOUT A LICENSE FROM THE CITY ; AND FOR OTHER PURPOSES , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 , That Section 1 of Ordinance 1726 , Section 16 - 11 , Code of Ordinances , Fayetteville , Arkansas , is hereby amended to read as follows : Private Security . Officer shall mean one engaged in the business of protecting private property for hire in the City of Fayetteville . Private Security Agent shall mean one employed by a private security officer . Section . 2 . That Section 2 of Ordinance No . 1726 , Section 16 - 12 , Code of Ordinances , Fayetteville , Arkansas is hereby amended to read as follows : The business of being a private security officer or the agent of a private security officer in the City of Fayetteville is hereby declared to be a privilege and for the exercise of such privilege there shall be levied a tax of twenty - five dollars ( $ 25 . 00 ) for the permit to be a private security officer and ten dollars ( $ 10 . 00 ) to be the agent of a private security officer for each and every calendar year . Section 3 . That Section 4 of Ordinance No . 1726 , Section 16 - 14 , Code of Ordinances , Fayetteville , Arkansas , is hereby amended to read as follows : The application , along with the fingerprints of the applicant , shall be submitted to the chief of police of the City of Fayetteville who will approve or reject the application and if the application is approved , and upon the filing of a five thousand dollar ($ 5 , 000 ) DEED 866 m035 MICROFILMED. DATE OCT 1 1978 REEL fidelity bond for a private security officer or the filing of a one thousand dollar ( $ 1 , 000 ) fidelity bond for an agent of a private security officer , the chief of police shall then issue the appropriate license . Section 4 . That Section 5 of Ordinance No . 1726 , Section 16 - 15 , Code of Ordinances , Fayetteville , Arkansas , is hereby amended to read as follows : It shall be the duty of the chief of police to approve any and all uniforms worn by private security officers and private security agents . All vehicles and identifications thereon used by said officers and agents must be approved by the chief of police . Section 5 . That Section 6 of Ordinance No . 1726 , Section 16 - 16 , Code of Ordinances , Fayetteville , Arkansas , is hereby amended to read as follows : Anyone acting as a private security officer or private security agent without the above described licenses shall be deemed guilty of a misdemeanor , and upon conviction shall be fined not less than one hundred dollars ( $ 100 . 00 ) or more than one thousand dollars ( $ 1 , 000 ) and/ or sentenced up to thirty days in the county jail . Each day of violation shall be deemed a separate offense . Section 6 . That all ordinances and resolutions , or parts thereof , in conflict herewith be , and they hereby are , repealed . Section 7 . That this ordinance shall be in full force and effect from and after its passage , approval , and publication . PASSED AND APPROVED THIS / 9 DAY OF9000 , i 1974 .
