BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Section 10 - 29 of the Code of Ordinances , City of Fayetteville , Arkansas , is hereby amended to read as follows : " Sec . 10 - 29 . Sames - Commercial Service . The minimum monthly commercial rate shall be Three Dollars ( $ 3 . 00 ) per month , for one can , for each commercial establish - ment , such can not to exceed thirty - two ( 32 ) gallons . In the event that commercial establishments require bulk pick - up service of cartons , crates , baskets or of any rubbish not placed in thirty - two ( 32 ) gallon capacity cans , for such com - mercial establishments the rate for bulk pick - up service shall be twenty - five cents ( $ . 25 ) per minute required per pick - up . Commercial sanitation service shall be the collection , haul - ing and disposal of garbage , rubbish and other services provided by the sanitation system of the City , twice per week , Monday through Friday , excepting authorized holidays for City employees , in all business areas . In the event commercial establishments require more than one can for any pick - up during a month , the monthly rate for each additional can shall be twenty - five cents ( $ . 25 ) times the normal number of monthly pick - ups for the establishments . No can shall exceed thirty - two ( 32 ) gallons in capacity . In the event commercial establishments require sanitation service more frequently than twice each week , the monthly rate for such additional service shall be twenty - five cents ( $ . 25 ) per additional pick - up per can . Section 2 . All ordinances and or parts of ordinances in conflict herewith , including specifically Section 10 - 29 of the Code of Ordinances , City of Fayetteville , Arkansas , are hereby repealed . The Board of Directors has determined that sanitation services provided by the City will have to be cur - tailed if sanitation revenues are not increased ; that a cur - tailment of such services would result in the large accumulation of garbage and trash which accumulations would be unsanitary and dangerous to the public health ; and that . the passage of this ordinance is necessary to enable the City to continue providing quality sanitation service on a basis which will prevent large accumulations of garbage and trash . Therefore , an emergency is hereby declared to exist , and this ordinance being necessary for the protection of the public health and welfare , shall be in full force and effect from and after its passage and approval .
