BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Sections 10 - 28 and 10 - 29 . 1 of the Code of Ordinances , City of Fayetteville , Arkansas , are hereby amended to read as follows : Section 10 - 28 . Rates prescribed - - residential service . The following rates be , and they are hereby , fixed as rates to be charged for sanitation services furnished by the sanitation system of the City of Fayetteville , Arkansas , which rates the Board of Directors finds and declares to be reasonable and necessary minimum rates to be charged : The monthly residential rates shall be $ 3 . 00 per month for a maximum of two cans , which cans shall not exceed 32 gallons each in size , plus $ 0 . 50 for each such additional can , per each single - family dwelling unit . Sanitation services shall be the collection , hauling and disposal of garbage not less than two times each week ; the collection , hauling and disposal of rubbish , leaves , grass , and shrubbery trimmings on a call basis , and other services provided by the sanitation system of the City of Fayetteville , Arkansas : Section 10 - 29 . 1 . Same - - Lodal type container service . The rate for any person using Lodal type containers for the collection of garbage shall be One Dollar ( $ 1 . 00 ) per cubic yard , per pick up . o < < , 862 PwE4 3 MiCROFI DATE , 31976 Section 2 . That all ordinances , or parts of ordinances , in conflict herewith be , and are hereby , repealed . Section 3 . The Board of Directors has determined that sanitation services provided by the City will have to be cur - tailed if sanitation revenues are not increased ; that a cur - tailment of such services would result in the large accumulation of garbage and trash by local residents which accumulations would be unsanitary and dangerous to the public health ; and that the passage of this ordinance is necessary to enable the City to continue providing quality sanitation service on a basis which will prevent large accumulations of garbage and trash . Therefore , an emergency is hereby declared to exist , and this ordinance being necessary for the protection of the public health and welfare , shall be in full force and effect from and after its passage and approval .
