NA41 '!. ;;'; ;c ,•F � • ' Iy l I / AN ORDINANCE AMENDING SUB- SECTION E OFrSECTION 1 OF ORDINANCE N0 , 1761 , SECTION 2116 ( e ) , CODE OF ORDINANCES , CITY OF FAYETTEVILLE , ARKANSAS . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section'. 1 . That Sub - section E of Section 1 of Ordinance No . 1761 , Section 21- 16 ( e ) , Code of Ordinances , City of Fayetteville , Arkansas , is hereby amended to read as follows : E . Water extensions outside the city . Water extensions within suburban water districts and cities which have contracted for water from the City shall be made at the expense of and in accordance with the policies of such districts and cities . Con- struction of extensions are to be made only upon approval by the Fayetteville City Water and Sewer Superintendent . Except for facilities needed to serve property within the City ' s limits , such as major transmission lines , pump stations , and water storage tanks , water extensions outside such districts and cities shall not be made except on the express approval of the Fayetteville Board of Directors , and in accordance with the following rules : ( 1 ) No service connections will be made to raw water transmission lines , except when a prior easement from the owner to the City provides for such . ( 2 ) Service connections to treated water mains may be made by the City to residences , businesses , and industries which are adjacent to any existing treated water main . In order to be considered adjacent , the following criteria must be met : a ) The length of the service pipe from the main to the meter box shall not be greater than sixty ( 60 ) feet , except when railroad and highway rights -of-way are traversed , then said distance shall not be greater than one hundred and fifty feet ( 150 ) . nh) 862 PiiCF A 94 MICROFILMED DATE OCT 1 3 1978 RET` (b ) The distance from the meter to the point or building where water will be used shall not be more than thirteen hundred ( 1300 ) feet . For industries located on a larger tract , this distance may be greater . ( 3 ) The Superintendent of the Water and Sewer Department is hereby authorized to make water connections out - side the corporate limits of the city . Such water connections shall meet the same specifications of construction as used within the corporate limits of the city , at the time the water connection is made . The plumbing to which a water connection is made under this section shall meet all applicable plumbing regulations and requirements of the city in effect at the time the connection is made . ( 4 ) Before any water connection is made pursuant to this ordinance , the owner of the property concerned shall sign a written agreement with the city , wherein and whereby such owner shall agree to abide by any and all ordinances , rules and regulations of the city then in effect or which may thereafter be adopted . The agreement shall also set forth the water service charges , provisions for discontinuance of service , and authorization for city employees to enter upon premises of the owner for the purpose of making in - spection , repairs , maintenance and disconnections . Section Z . That all ordinances and/ or resolutions in conflict herewith , including ' specifically ' Resolution ' S =.64 , be , and are hereby ,repealed . Section 3 . Whereas , there are inhabitants in the rural growth area of the City of Fayetteville , Arkansas , who are seriously in need of improvements of the kind authorized by this ordinance , the absence of which improvements result in such inhabitants being deprived of pure water for drinking purposes , and for domestic and industrial use , and fire pro - tection , which condition menaces the public health and safety ; and , whereas , the passage of this ordinance will create a means of providing such improvements to said in - habitants , which are not available under existing ordinances . THEREFORE , IT IS HEREBY DECLARED that an emergency exists , and that this ordinance is necessary for the immed - iate preservation of the public peace , health and safety , DEPD 862 M G F •J,L95 i and that this ordinance shall take effect and be in full force from and after its passage .
