AN ORDINANCE WAIVING THE STREET GRADE RESTRIC-TIONS OF
ORDINANCE NO . 1750 AS SAID RESTRICTIONS AND REQUIREMENTS
APPLY TO BROPHY ADDITION TO THE CITY OF FAYETTEVILLE , ARK -
ANSAS .
WHEREAS , The Board of Directors of the City of Fayette -
ville , Arkansas , finds that the street grade restrictions
of Ordinance No . 1750 will cause undue harship to the devel -
oper of Brophy Addition to the City of Fayetteville , Arkansas ,
and ,
WHEREAS , The granting of a waiver from said restrictions
and requirements will not nullify the intent and purpose of
City Ordinance No . 1750 , but is necessary so that substantial
justice may be done and the public interest secured ,
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the street grade restrictions of City
Ordinance No . 1750 be , and hereby are , waived as said restric -
tions apply to Westview Street in Brophy Addition to the City
of Fayetteville , Arkansas ,
Section 2 . That this ordinance shall be in full force
and effect from and after its passage , approval and publication .
