AN ORDINANCE TO ACCEPT AND CONFIRM THE FINAL PLAT OF
THE REPLAT OF BROPHY ADDITION TO THE CITY OF FAYETTEVILLE ,
ARKANSAS ; AND TO ACCEPT AND CONFIRM THE DEDICATION OF PUBLIC
STREET AND UTILITY EASEMENTS THEREIN .
WHEREAS , There has been presented to the Board of Direc -
tors of the City of Fayetteville , Arkansas , a plat known as
the final plat of Brophy Addition , Phase II , to the City of
Fayetteville , Arkansas , in which the owner has dedicated for
the public use the street and utility easements shown upon
said plat .
WHEREAS , The Planning Commission of the City of Fayette -
ville , Arkansas , has recommended the acceptance of said plat
upon condition that ( 1 ) that the Board of Directors waive the
subdivision regulations so as to permit a grade in excess of
15 $ on "Westview Street" , ( 2 ) that sidewalks be shown on the
final plat on one side of Karen and Jimmy Avenues - the por -
tions extended - but that sidewalks be waived on Westview
Street , and ( 3 ) that the location of an easement in Block 3
be corrected .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the City of Fayetteville , Arkansas ,
hereby accepts and confirms the final plat of the replat of
Brophy Addition upon condition that ( 1 ) the Board of Directors
waive the subdivision regulations so as to permit a grade in
excess of 15 % on "Westview Street " , ( 2 ) sidewalks be shown
on the final plat on one side of Karen and Jimmy Avenues and
( 3 ) the location of an easement in Block 3 be corrected .
The City of Fayetteville , Arkansas , also hereby accepts and
confirms the dedication of the street and utility easements
shown therein , and hereby declares said street and utility
easements to be public street and utility easements and the
Board of Directors hereby assumes the care , control and juris -
diction of same .

and effect from and after its passage , approval and publica -
tion .
