AN ORDINANCE MODIFYING THE SIDEWALK REQUIREMENTS OF ORDIN -
ANCE N0 , 1750 AS SAID REQUIREMENTS APPLY TO ROSEWOOD ESTATES
ADDITION TO THE CITY OF FAYETTEVILLE , ARKANSAS ,
WHEREAS , The Board of Directors of the City of Fayetteville ,
Arkansas , finds that the sidewalk requirements of Ordinance No .
1750 will cause undue hardship to the developer of Rosewood
Estates Addition to the City of Fayetteville , Arkansas , and ;
WHEREAS , The granting of a waiver from said requirements
will not nullify the intent and purpose of City Ordinance No .
1750 , but is necessary so that substantial justice may be
done and the public interest secured .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the provisions of the sidewalk require -
ments of City Ordinance No . 1750 be , and hereby are , modified
in the following respect : sidewalks shall not be required in
those areas of Rosewood Estates Addition which the City Manager
and City Engineer deem of such topography as to make sidewalks
impractical .
Section 2 . That this ordinance shall be in full force and
effect from and after its passage , approval and publication .
