AN ORDINANCE TO ACCEPT AND CONFIRM THEL `IN6,11 yAT OF
JOHNSON ROAD SUBDIVISION TO THE CITY OF FAYETTEVLLLE , ARKANSAS ;
AND TO ACCEPT AND CONFIRM THE DEDICATION OF PUBLIC STREET AND
UTILITY EASEMENTS THEREIN .
WHEREAS , There has been presented to the Board of Directors
of the City of Fayetteville , Arkansas , a plat known as the final
plat of Johnson Road Subdivision to the City of Fayetteville ,
Arkansas , in which the owner has dedicated for the public use
the street and utility easements shown upon said plat .
WHEREAS , The Planning Commission of the City of Fayette -
ville , Arkansas , has recommended the acceptance of said plat .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That the City of Fayetteville , Arkansas , here -
by accepts and confirms the final plat of Johnson Road Subdiv -
ision conditioned upon ( 1 ) dedication of an additional five feet
of street right of way parallel and adjacent to the westernmost
boundary of said subdivision , ( 2 ) granting of a thirty foot
water and sewer easement parallel and adjacent to the northern -
most boundary of Lot No . 41 , ( 3 ) granting of drainage easements
across Lot No . 41 as required by the City Engineer , ( 4 ) removal
of the following wording from the plat , " Lot No . 41 is reserved
for floodplain , utility and drainage easement , ( S ) execution
of a contract by the developer to guarantee the installation of
improvements required by City subdivision regulations . The
City of Fayetteville , Arkansas also hereby accepts and confirms
the dedication of the street and utility easements shown therein ,
and hereby declares said street and utility easements to be
public street and utility easements and the Board of Directors
hereby assumes the care , control and jurisdiction of same .
Section 2 . That this . ordinance shall be in full force and
effect from and after its passage , approval and publication .
