ALMA KOLLMEYER
AN ORDINANCE VACATING AND ABANDONING A WATERCARND "SEWERK
EASEMENT .
WHEREAS , the City of Fayetteville , Arkansas , secured a
water and sewer easement in 1968 over property owned by Cleo
Morrow ; and
WHEREAS , the Board of Directors of the City of Fayetteville ,
Arkansas , deems it desirable to vacate and abandon said water
and sewer easement .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . The City of Fayetteville , Arkansas , hereby
releases , vacates , and abandons all its rights , together with
the right of the public generally , in and tothe following
described water and sewer easement :
A permanent easement of 25 feet in width , being 10 feet
to the east and 15 feet to the west of a centerline of
a 12 inch sewer line and more particularly described as
follows , to - wit :
Beginning at a point in the south line of the following
described real estate , said point being 524 feet west
of the Southeast corner thereof , and running thence north
305 feet to a point in the north line of the following
described real estate , said point being 524 feet west
of the Northeast corner of the following described real
estate , to - wit :
A part of the Northwest quarter of the Northwest quarter
of Section 33 , in Township 16 North , of Range 30 West ,
described as follows , to - wit :
Beginning at a point in the centerline of U . S . Highway
No . 71 which is 15 chains 8331 links south of the north
line of said 40 acre tract , in running , thence west 18
chains 411� links to the east line of the right of way
of the St . Louis and San Francisco Railroad ; thence south
bearing east with the east line of said Railroad right
of way 3 chains 5431 links to the north side of the public

road , thence east 17 chains and 77 links to the centerline
of U . S . Highway No . 71 ; thence northerly with the center -
line of said Highway 3 chains and 29 links or to the place
of beginning , containing 5 . 95 acres , more or less ;
which easement is filed in the Office of the County Recorder of
Washington County and recorded in the Deed of Records of the
County in Book 728 at page 420 .
Section 2 . A copy of the Ordinance duly certified by the
City Clerk shall be filed in the Office of the Recorder of the
County and recorded in the Deed of Records of the County .
Section 3 . This Ordinance shall be in full force and
effect from and after its passage , approval and publication .
