AN ORDINANCE AUTHORIZING THE IMPROVEM I . iO ,SYCAMORE
STREET FROM HIGHWAY 71 ( COLLEGE AVENUE ) TO WOdLSEY- AVENUE ;
LEVYING ASSESSMENTS AGAINST THE PROPERTY BENEFITED THEREBY ;
STATING THE MANNER IN WHICH SUCH ASSESSMENTS ARE PAYABLE ;
AND STATING THE TIME WITHIN WHICH SAID ASSESSMENTS ARE PAY -
ABLE .
WHEREAS , a majority in value of the owners of real
property benefited by the improvement of Sycamore Street
from Highway No . 71 ( College Avenue ) to Woolsey Avenue
have petitioned the Board of Directors for the construction
of said improvements and that a portion of the cost thereof
be assessed upon the real property benefited , according to
benefits received .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That all of the real property situated in
the following territory located in the City of Fayetteville ,
Arkansas :
Part of the SW ; Sec . 3 , the SE ; Sec. . 4 , the
NE ; Sec . 9 and the NW 4 Sec . 10 T 16 N , R 30
W more particularly described as follows : Begin -
ning 532 ' - 2 " east and 200 ' - 2 " north of the SW
corner of the SW ; of the SW ; of Sec . 3 T 16 N ,
R 30 W ; said point of beginning being on the
west right of way line of Hwy . 71 North ; thence
west 29S ' - 1 " ; thence north 95 ' - 2 " ; thence west
237 ' - 1 " ; thence north 1 ' - 10 " ; thence west 146 ' - 8 " ;
thence south 205 . 31 ; thence west 183 ' ; thence
north 109 . 911 ; thence west 339 . 09 ' ; thence south
99 . 141 ; thence west 2041 ; thence north 66 . 111 ;
thence west 1961 ; thence south 17 . 831 ; thence
west 264 ' ; thence south 150 ' to the north right
of way line of Sycamore St . ; thence southeasterly
40 ' to the SE corner of the Sycamore and Woolsey
St . right of way lines ; thence south along the
east right of way line of Woolsey St . 3851 ; thence
east 4101 ; thence south 3501 ; thence east 7331 ;
thence north 1001 ; thence east 1651 ; thence north
635 ' ; thence east 422 . 5 ' to the west right of way
of Hwy . 71 North thence in a northeasterly direction
along said right of way line to the point of begin -
ning .

be and the same is hereby formed into a local assessment
district for the purpose of improving Sycamore Street from
Highway No . 71 ( College Avenue ) to Woolsey Avenue ,
Section 2 . That pursuant to the Report on the Improve -
ment of Sycamore Street from Highway 71 ( College Avenue )
to Woolsey Avenue the Street Department of the City of
Fayetteville , Arkansas , is hereby authorized and directed
to accomplish the following :
a ) Excavation of existing street right - of - way ;
b ) Construction of base to meet current city standards ;
c ) Paving with two ( 2 ) inches of hot mix asphaltic
materials to current city standards ;
d ) Installation of curb and gutter on the north side
of said street ; and
e ) Installation of 4 - foot concrete side walk on the
south side of said street .
Section 3 . That the several lots , blocks or other sub -
divisions of real property within said assessment district
be , and they are , hereby assessed as per the schedule of
assessments on file with the City Clerk of the City of Fay -
etteville , Arkansas , which assessments bear interest at the
rate of ten percent ( 10 % ) per annum from October 1 , 1973 ,
unless the property owner ( s ) choose ( s ) to pay in a lump sum
as hereinafter provided .
Section 4 . That ten percent ( 10 % ) of said assessment
of the value of the benefits of each of said lots , blocks
or subdivisions of land shall be paid annually on or before
the time provided by law for paying the first installment
of general taxes on the property until the whole of said
assessment shall have been paid , beginning February 18 , 1974 .
Section 5 . That the property owner ( s ) may pay the
assessments levied in a lump sum payable within thirty ( 30 )
days after the completion of the proposed improvements .
Section 6 . That all Ordinances and all parts of Ordin -
ances in conflict herewith are hereby repealed and this
Ordinance shall be in full force and effect from and after
its passage , approval and publication .
