CIRCUIT CLERIC
AN ORDINANCE PROVIDING A PENALTY FOR OPERATING A PRIVATE
CLUB IN THE CITY OF FAYETTEVILLE , ARKANSAS , WITHOUT A PRIVATE
CLUB LICENSE, AND PROVIDING A PENALTY FOR OPERATING A PRIVATE
CLUB WITHOUT PAYMENT OF THE SUPPLEMENTAL TAX ; AND ESTABLISHING
STANDARDS FOR REVOCATION OF LICENSES .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . That the Code of Ordinances , City of Fayette -
ville , Arkansas , is hereby amended by adding a section to be
numbered 3 - 115 , which said section reads as follows :
" Sec . 3 - 11S . Penalty .
Any person who shall operate a private club in the City
of Fayetteville , Arkansas , without securing a license
from the City of Fayetteville , shall be guilty of a mis -
demeanor and , upon conviction , shall be fined in a sum of
not less than $ 25 and not more than $ 250 . 00 for the first
offense ; and upon conviction of a second or any successive
violation of this section within twelve months of a pre -
ceding conviction , shall be fined as set out above or shall
be imprisoned for not less than one day nor more than 30
days or both . "
Section 2 . That the Code of Ordinances , City of Fayette -
ville , Arkansas , is hereby amended by adding a section to be
numbered 3 - 116 , which said section reads as follows :
" Sec . 3 - 116 . Penalty for Failure to Pay Supplemental Tax .
In addition to the penalty for non - payment of supplemental
tax defined in Sec . 3 - 114 hereof , any permitee who shall
fail to remit his supplemental tax upon gross receipts for
two consecutive months shall be guilty of a misdemeanor
and , upon conviction , shall be fined in a sum not less than
$ 25 and not more than $ 250 for the first offense ; and upon
conviction of a second or any successive violation of this
section occurring within twelve months of a preceding con -
viction , shall be fined as set out above and shall be
imprisoned for not less than one day nor more than 30 days
or both , and , in addition thereto shall suffer the revocation
of his city license to do business as a private club , if he
possesses such license . "

Section 3 . That sub - section ( d) of Section 3 - 113 of the
Code of Ordinances , City of Fayetteville , Arkansas , is hereby
amended to read as follows :
" ( d) Licenses required by this article shall be issued in
such a manner that they will run for such length of time
as will be concurrent with the permit issued by the state .
Provided , however , that the Board of Directors of the City
of Fayetteville , Arkansas may revoke said city license if
the Board of Directors finds , after due notice to the
licensee and an opportunity for the licensee to be heard ,
that the application for the private club permit contained
false or misleading information which would have affected
the issuance of said license . The Board of Directors may
also revoke said license if the Board of Directors finds ,
after due notice to the licensee and an opportunity for
the licensee to be heard , a consistent history of late pay -
ment of the supplemental tax on gross revenues provided
in Section_ 3 - 114 of this Article . "
Section 4 . That all ordinances and all parts of ordinances
in conflict herewith are hereby repealed and this ordinance shall
be in full force and effect from and after its passage , approval
and publication .
