WHEREAS , a public hearing was held before Athti611 On-;•pg Commis -
sion of the City of Fayetteville , Arkansas , on �b� �ary - 6 , 1973 ,
on a petition requesting an amendment to Ordinance No . 1747 to
permit planned unit developments with a minimum of five ( 5 ) acres .
WHEREAS , notice of said public hearing setting forth the
time , date , place and purposes of said hearing was published in
a newspaper of general circulation in the city , more than fifteen
( 15 ) days prior to said public hearing , and
WHEREAS , following said public hearing , said Planning Commis -
sion certified to the Board of Directors its recommendation that
an ordinance be adopted amending Ordinance No . 1747 to permit
planned unit developments with a minimum of five ( 5 ) acres or
fifty ( 50 ) dwelling units .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That Article 8 , Section 12 , Paragraph ( A) of
Ordinance Number 1747 [Appendix A , Code of Ordinances , Fayette -
ville , Arkansas ] be amended to read as follows :
" (A) Authorization of Planned Developments .
Planned developments are authorized to be established in all
districts , subject to the requirements of this Article , and
all other pertinent provisions of these regulations , provided
that each such development shall consist of a minimum of
five ( 5 ) acres . Height shall be limited to two ( 2 ) stories
plus basement in Planned Unit Developments in R - 1 District .
Section 2 . That all ordinances or parts of ordinances in
conflict herewith are hereby repealed and this ordinance shall be
in full force and effect from and after its passage , approval ,
and publication .
