AN ORDINANCE AMENDING ORDINANCE NO . 1747 TO P�I ' f11j*&[iACATION OF
SERVICE STATION CANOPIES WITHIN 20 FEET OF RIGHT OF iV.4 LINES ; AND FOR
OTHER PURPOSES .
WHEREAS , a public hearing was held before the Planning Commission
of the City of Fayetteville , Arkansas , on June 6 , 1972 , on a proposed
amendment to permit service station canopies within 20 feet of right of
way lines , and ;
WHEREAS , notice of said public hearing setting forth the time , date ,
place and purposes of said hearing was published in the Northwest Arkansas
Times , a newspaper of general circulation in the City , more than fifteen
( 15) days prior to said public hearing , and ;
WHEREAS , following said public hearing , said Planning Commission
certified to the Board of Directors of the City of Fayetteville , Arkansas ,
its recommendation that an Ordinance be adopted amending Ordinance No . 1747 .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF FAYETTEVILLE , ARKANSAS :
Section 1 . That Article 7 , Section 9 , Subsection (a) of Ordinance
No . 1747 (Appendix A , Code of Ordinances , City of Fayetteville , Arkansas )
is hereby amended by adding the following :
"Minimum set back of canopy covering pump island , compressed
air connection and similar equipment from all right - of-way
lines - 20 feet . Provided , however , that canopies shall not
be considered a part of the building for determining building
set -backs even if said canopies are attached to the principal
structure . "
Section 2 . That all ordinances or parts of ordinances in conflict
herewith are hereby repealed and this ordinance shall be in full force and
effect from and after its passage , approval and publication .
